About approval of Rules of recognition of specialties of foreign states in the field of the higher education and determination of their equivalence (nostrification)

1. Approve "Rules of recognition of specialties of foreign states in the field of the higher education and determination of their equivalence (nostrification)" (are applied).

2. This resolution becomes effective from the date of signing.

Rules of recognition of specialties of foreign states in the field of the higher education and determination of their equivalence (nostrification)

I. General provisions

1.1. These rules are developed on the basis of Item 1 of the Order of the President of the Azerbaijan Republic "About some measures connected with implementation of the Law of the Azerbaijan Republic "About approval of the Convention on recognition in the European region of specialties in the field of the higher education" of March 6, 2000 No. 346.

1.2. Recognition of specialties of foreign states in the field of the higher education is meant as confirmation of stay in force in the territory of the Azerbaijan Republic of any document, the diploma or other certificate granted by competent authorities of foreign states, certifying successful completion of the program of the higher education appropriating this or that degree.

1.3. Determination of equivalence of specialties of foreign states in the field of the higher education means provision to owners of the documents issued by competent authorities of foreign states and certifying data acquisition of specialties, the same academic and professional privileges which allocate owners of the documents on the higher education issued in the Azerbaijan Republic.

1.4. The certificate on recognition of specialty of foreign state in the field of the higher education and about its equivalence grants to its owner the right to additional (second) specialty, on advanced training, on acceptance on the preparation step following the diploma, and is equal on implementation of the related professional activity.

1.5. Recognition of specialty of foreign state in the field of the higher education and determination of its equivalence does not exempt owners of the documents certifying receipt of this specialty from observance in case of employment in the Azerbaijan Republic of the general requirements established by the legislation of the Azerbaijan Republic.

1.6. Recognition of specialties of foreign states in the field of the higher education and issue of the Certificate on recognition are performed by the Ministry of Education of the Azerbaijan Republic on the basis of these rules.

The certificate on determination of equivalence of specialties of foreign states in the field of the higher education is granted by the Ministry of Education of the Azerbaijan Republic after the expertize which is carried out on the basis of the provisions provided in these rules.

If equivalence is defined by international treaties and interstate agreements with participation of the Azerbaijan Republic, the Certificate on equivalence is granted without examination.

1.7. Recognition of specialties of foreign states in the field of the higher education, determination of their equivalence and issue of the appropriate certificate are performed based on the statement of the owner of the document or the address interested in volume of the organization, legal entities and physical persons.

II. The organization of the procedure of recognition of specialties in the field of the higher education

2.1. In the field of the higher education are applied to the address (statement) for recognition of specialty:

- document on the higher education;

- receipt on payment of the state fee;

- appendix to the document on the higher education with indication of the taught disciplines, their amount, final estimates, results of practical, term and final papers, other indicators constituting educational process.

The applicant can submit also the documents confirming the level of its preparation, receipt of permission to the related professional activity and practical experience.

Transfer of the document on the higher education and appendices to it into Azerbaijani and the notarial attestation of this transfer shall be legalized, as a rule, in Embassy (consulate) of the Azerbaijan Republic or in the Consular establishment of the Ministry of Foreign Affairs of the Azerbaijan Republic located in the country which issued the document on the higher education.

2.2. The procedure of recognition of specialties of foreign states in the field of the higher education is carried out on the basis of the existing international agreements and recommendations, state standards of education and regulatory legal acts regulating education system of the Azerbaijan Republic.

2.3. Following availability is important for recognition of specialties in the field of the higher education:

- recognition of the document on the higher education in the country which issued it;

- prediscretion of recognition of specialties in the field of education by international treaties of the Azerbaijan Republic.

2.4. The documents submitted by the applicant are considered, as a rule, within 1 month from the date of submission of all proper documents.

2.5. In case of refusal in recognition of specialty in the field of the higher education of the reason, been the basis for refusal, are explained to the applicant in writing.

III. Determination of equivalence of specialties in the field of the higher education

3.1. For determination of equivalence of specialties in the field of the higher education the documents listed in Item 2.1 of these rules are required.

3.2. Determination of equivalence of specialties in the field of the higher education is performed in the following procedure:

- examination - recognition of the specialties in the field of the higher education appropriated in foreign states and determination of compliance of the education got in foreign state, to the standards of education existing in the Azerbaijan Republic;

- determination of compliance of content of the education got in foreign state, to state standards of education in the Azerbaijan Republic (after recognition of specialty of foreign state in the field of education).

3.3. For the purpose of determination of compliance of content of education to state standards scientific and methodical divisions of the Ministry of Education of the Azerbaijan Republic and expert group as a part of highly qualified specialists of education system are created.

3.4. In case of examination the following is considered:

- contents of the curriculum and training programs;

- certification systems;

- amount of the studied disciplines;

- results of certification for disciplines;

- know-how and its term;

- result of final assessment.
