About archives and archiving of Turkmenistan
This Law determines the legal basis of the organization of completing, storage, accounting, use of documents of National Archive Fund of Turkmenistan and other archive documents, and also managements of archives for the benefit of society, the states and citizens.
In this Law the following basic concepts are applied:
archiving - activities of the state, legal entities and physical persons for completing, storage, accounting and use of documents of National Archive Fund of Turkmenistan and other archive documents, and also for management of archives;
the document - material object with information on objects of reality and on cogitative activities of the person fixed on it by means of the letter, graphics, the photo, zvuko-and videos or in a different way on any medium;
the archive document - the document kept or which is subject to preserving owing to its importance for society, the state, citizens;
audiovisual documents - film, photo, phono - the video documents and their combinations created or reproduced on any kinds of carriers;
documents on staff - complex of the documents created in the course of documentation of office, employment or other social legal relationship of citizens and legal entities;
the document of National Archive Fund of Turkmenistan - the archive document which passed the examination of value, delivered on the state accounting and subject to permanent storage;
especially important document - the document of National Archive Fund of Turkmenistan having the inherent historical and cultural, scientific value, and also special importance for society and the state and irreplaceable when losing from the point of view of its legal value and (or) avtografichnost;
the unique document - especially important document which does not have similar according to information containing in it and (or) external signs;
National Archive Fund of Turkmenistan - historically developed and constantly replenished set of the archive documents which are subject to permanent storage, reflecting material and spiritual life of the Turkmen people, having historical, scientific, social, economic, political, cultural value, being integral part of its historical and cultural heritage and being part of information resources of the state;
archival fund - set of archive documents, historically or logically connected among themselves;
the Public Records Offices - the public archival institutions performing acceptance, permanent storage, accounting and use of archive documents;
departmental archives - the archives created by public authorities and local self-government and also the companies, organizations and the organizations of various patterns of ownership for completing, storage, accounting and use of the documents formed in their activities;
secret archive - archive which it is not declared publicly;
private archives of citizens - the archives formed as a result of activities of person, family, the sorts collected or acquired by inheritance, purchase or donation;
permanent storage of archive documents - their eternal, dead storage;
temporary storage of archive documents - their storage during the terms established by regulatory legal acts of Turkmenistan;
depositary storage of archive documents - their storage during terms and on the conditions determined by the contract between the owner of documents and the Public Records Office;
the owner of archive documents - the state, legal entity or physical person in full exercising rights of possession, uses, orders of archive documents;
