About approval of the Procedure for acceptance in operation of individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, extensions to them, public houses and buildings and constructions of agricultural purpose of I and II categories of complexity which are built without the permission on accomplishment of construction works, and carrying out technical inspection of their building constructions and engineering networks

According to the subitem 30 of Item 7 of the Section I of the Law of Ukraine of November 20, 2012 No. 5496-VI "About modification of some legal acts of Ukraine concerning regulation of town-planning activities" PRIKAZYVAYU:

1. Approve the Procedure for acceptance in operation of individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, extensions to them, public houses and buildings and constructions of agricultural purpose of I and II categories of complexity which are built without the permission on accomplishment of construction works, and carrying out technical inspection of their building constructions and engineering networks which is applied.

2. Determine what the reports on carrying out technical inspection of building constructions and engineering networks constituted after January 05, 2013 is effective in case of submission of documents for acceptance in operation of the individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, extensions to them built during the period from August 05, 1992 to March 12, 2011 and public houses I and II of categories of complexity which are built till March 12, 2011.

3. To department of normative legal regulation (Vernigor Yu. Yu.) together with the State architectural and construction inspection of Ukraine (Rybak O. V.) in the procedure established by the legislation to provide submission of this order on the state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the deputy minister Isayenko D. V.

Procedure for acceptance in operation of individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, extensions to them, public houses and buildings and constructions of agricultural purpose of I and II categories of complexity which are built without the permission on accomplishment of construction works, and carrying out technical inspection of their building constructions and engineering networks

I. General provisions

1.1. This Procedure establishes the procedure and conditions of acceptance in operation of the construction works constructed without the permission on accomplishment and the mechanism of carrying out technical inspection of building constructions and engineering networks:

the individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, extensions to them constructed during the period from August 05, 1992 to March 12, 2011;

constructed till March 12, 2011:

public houses I and II of categories of complexity;

buildings and constructions of agricultural purpose of I and II categories of complexity.

1.2. In this Procedure terms are used in such values:

economic (home) buildings - auxiliary (non-residential) rooms to which sheds, sheds, garages, summer kitchens, masterful, wardrobe, cellars, canopies, boiler rooms, boiler rooms, transformer substations, etc. belong;

economic (home) constructions - land improvements which do not belong to buildings and rooms, intended for accomplishment of special technical functions to which wells, cesspools, barriers, gate, gates, zamoshcheniya, etc. belong;

the country house - the house which is used within year for the purpose of suburban rest;

the customer - person who has the property right or right to use by the parcel of land on which object is placed and submitted the corresponding application in the procedure established by the legislation;

the individual (farmstead) apartment house - the building of capital type built with observance of the requirements established by the law, other regulatory legal acts which superficiality shall not exceed four floors, intended for permanent accommodation in it and which consists of housing and auxiliary (non-residential) rooms;

the garden house - the house for summer (seasonal) use;

technical inspection of building constructions and engineering networks of objects complex of the actions directed to establishment of technical condition of building constructions and engineering networks of objects for the purpose of determination of opportunity or impossibility of their safe operation.

Public houses and buildings and constructions of agricultural purpose which belong to I and II categories of complexity are determined according to construction regulations, state standards and rules.

II. Carrying out technical inspection

2.1. Technical inspection of building constructions and engineering networks of the objects specified in Item 1.1 of the Section I of this Procedure (further - objects), is carried out according to this Procedure taking into account requirements of the legislation in the field of town-planning activities, construction regulations, state standards and governed the contractor.

2.2. Technical inspection of building constructions and engineering networks of objects (further - technical inspection of objects) includes such stages:

preliminary (visual) survey of object, including survey and photography of object and its structural elements, determination of category of complexity of object, the solution of question concerning need of use of the special equipment, devices and the equipment during technical inspection;

detailed (tool) inspection of object, including determination of parameters and characteristics of materials, products and designs, and also if necessary excitation before the contractor of question concerning attraction to technical inspection of the certified laboratories for carrying out necessary researches or other responsible specialists for acceptance of reasoned decision.

If stages of technical examination of object which was conducted do not match with the specified stages, actually passable stages of technical inspection are specified.
