Rules of the admission to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution

1. General provisions

1. These rules of the admission to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution (further - Rules) are developed according to the order of the Government of the Republic of Kazakhstan of January 23, 2008 No. 51 "About Approval of Rules of Work of State Bodies with Office Information" chipboard and the order of the Government of the Republic of Kazakhstan of January 13, 2012 No. 40 "About approval of Rules of sales of goods in duty-free shops, additional terms of inclusion in the register of owners of duty-free shops".

Data on accreditation of the diplomatic representations equated to them representative offices of the international organizations, consular establishments, and also diplomatic agents, consular officials and members of their families who live together with them (further - office information) belong to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan (further - the Ministry) limited distribution to which admission is regulated by Rules.

The legal entities intending to open duty-free shop in the capital are allowed to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution (further - the Applicant).

3. The legal entities allowed to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution:

1) do not place information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution in global and local information networks;

2) do not use it for open performances or publication in mass media;

3) do not exhibit office information at open exhibitions, do not show them at stands, in show-windows or other places of mass review;

4) are not copied, scanned, transferred by means of communication and do not make other actions promoting information leakage of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution.

2. Procedure for the admission to information of the Ministry of Foreign Affairs of the Republic of Kazakhstan of limited distribution

4. In case of lack of technical capabilities for receipt of office information on means of electronic document management, the Applicant signs the contract with the organization for work with diplomatic corps of the Ministry on provision of information support.

For the conclusion of the agreement on provision of information support the Applicant submits the following documents to the organization for work with diplomatic corps:

1) certificate of state registration (re-registration) of the legal entity;

2) notarially attested copy of the document confirming registration of person as the taxpayer;

3) notarially attested copies of constituent documents;

4) confirmations from banks about the accounts opened in them;

5) notarially attested copies of the documents confirming rights of possession with the rooms suitable for use as duty-free shop;

6) plans, drawings of the rooms and the territories declared as duty-free shop;

7) notarially attested copies of the documents proving the identity and orders on position assignment originals of the address certificate of the place of residence, the certificate of availability or lack of criminal record of workers of the Applicant which will have access to office information;

5. The organization for work with diplomatic corps of the Ministry within 10 (ten) working days from the date of provision of documents of the Rules specified in Item 3 signs contracts on provision of information support.

6. The price of the agreement on provision of information support by the organization for work with diplomatic corps of the Ministry is created on the basis of actual costs of the organization for work with diplomatic corps of the Ministry on implementation of information support.

7. After the conclusion of the contract with the organization for work with diplomatic corps of the Ministry about provision of information support the Applicant files in the Ministry petition, constituted in any form to which the following documents are attached:

1) certificate of state registration (re-registration) of the legal entity;

2) notarially attested copy of the document confirming registration of person as the taxpayer;

3) notarially attested copies of constituent documents;

4) confirmations from banks about the accounts opened in them;

5) notarially attested copies of the documents confirming right of possession with the rooms suitable for use as duty-free shop;

6) plans, drawings of the rooms and the territories declared as duty-free shop;

7) contract with the organization for work with diplomatic corps on provision of information support;

8) notarially attested copies of the documents proving the identity and orders on position assignment, originals of the address certificate of the place of residence the document on lack of criminal record, the medical certificate on professional suitability of the established uniform of employees of the Applicant which will have access to office information.

8. The ministry following the results of consideration of the address of the Applicant within 15 calendar days, is in writing informed on the accepted one of the following decisions:

1) about the admission to information of the Ministry of limited distribution;

2) about refusal in the admission to information of the Ministry of limited distribution.
