In this Law the following main terms and their determinations are used:
approbation of agricultural plants - inspection of agricultural plants, their crops (landings) for the purpose of determination of varietal purity or high-quality typicalness of agricultural plants, contaminations of crops (landings) by weed and other plants, defeats by diseases and vermin damages of plants;
the state register of grades - single databank about grades of the agricultural plants which passed the state test of grades and allowed for production, realization and uses of their seeds in the territory of the Republic of Belarus;
soil control - method of determination of varietal purity or high-quality typicalness of agricultural plants when carrying out approbation of agricultural plants by means of crops (landing) of seeds of agricultural plants on special sites;
laboratory high-quality control - method of determination of varietal purity or high-quality typicalness of agricultural plants by means of carrying out laboratory seed analysis of agricultural plants;
forest plants - the wood and shrubby vegetation used in forestry;
original seeds of agricultural plants - the seeds of agricultural plants intended for production of elite seeds of agricultural plants and made by the author of grade (selector) or persons authorized by it which provide maintenance of high-quality qualities of seeds of agricultural plants and perform activities for production of original seeds of agricultural plants of grade;
batch of seeds of plants - certain quantity homogeneous by origin and to quality of seeds of plants of the corresponding grade;
sowing qualities of seeds of plants - set of signs of seeds of the plants characterizing their suitability for crops (landing);
producers of seeds of agricultural plants - legal entities and physical persons, including the individual entrepreneurs performing activities for production of seeds of agricultural plants according to this Law;
the register of producers of seeds of agricultural plants - single databank about producers of original and elite seeds of agricultural plants;
reproductive seeds of agricultural plants - seeds of agricultural plants of the subsequent generations after elite seeds of agricultural plants;
agricultural plants - the grain, leguminous, fodder, groat, technical, flower, vegetable, fruit, berry plants, potatoes and other plants used in agricultural industry;
seeds of plants - actually seeds of plants, saplings, fruits, parts of aggregate fruits, compound fruits, bulbs, tubers, meristematic materials and other generative and vegetative parts of plants intended for reproduction of plants;
seed farming - the activities connected with production, storage, realization and use of seeds of plants, and also with holding actions for determination of high-quality and sowing qualities of seeds of plants;
high-quality typicalness of agricultural plants - indicator of varietal purity perekrestnoopylyayushchikhsya agricultural plants;
varietal purity of agricultural plants - the attitude of number of agricultural plants of grade or their stalks towards total number of plants or their stalks to which the grade, on the inspected crops (landing) of plants belongs;
high-quality qualities of seeds of agricultural plants - set of signs of the agricultural plants characterizing belonging of their seeds to certain grade;
elite seeds of agricultural plants - the seeds of agricultural plants received from consecutive reproduction of original seeds of agricultural plants according to the scheme of their production and used for production of reproductive seeds of agricultural plants.
This Law governs the relations connected with seed farming of agricultural and forest plants, including genetically engineered and is directed to conditioning for receipt of seeds of plants with the best high-quality and sowing qualities.
Operation of this Law does not extend to the relations arising when implementing seed farming by physical persons for own needs and not pursuing at the same time revenue generating purposes.
The legislation on seed farming is based on the Constitution of the Republic of Belarus and consists of this Law, acts of the President of the Republic of Belarus and other acts of the legislation on seed farming, and also international treaties of the Republic of Belarus.
The relations connected with seed farming of forest plants are regulated by the legislation on seed farming if other is not established by the legislation on use, protection, protection and reproduction of the woods.
The relations connected with seed farming of genetically engineered plants are regulated by the legislation on seed farming if other is not established by the legislation on safety of genetically engineered activities.
The relations connected with seed farming of the plants belonging to the grades entered in the State register of the protected plant varieties of the Republic of Belarus are regulated by the legislation on seed farming if other is not established by acts of the legislation on patents for plant varieties.
If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
State regulation of seed farming is performed by the President of the Republic of Belarus, Council of Ministers of the Republic of Belarus, the Ministry of Agriculture and Food of the Republic of Belarus, the Ministry of forestry of the Republic of Belarus, local councils of deputies, executive and administrative organs and other state bodies within their competence.
The president of the Republic of Belarus in seed farming determines single state policy and performs other powers according to the Constitution of the Republic of Belarus, this Law and other legal acts.
Council of Ministers of the Republic of Belarus:
provides carrying out single state policy in seed farming;
approves state programs in seed farming;
establishes procedure for carrying out the state testing of grades if other is not established by legal acts;
