RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

of April 5, 2013 No. PP-1948

About optimization of system of electronic procurement and expansion of access of subjects of entrepreneurship to them

(as amended of the Presidential decree of the Republic of Uzbekistan of 06.07.2017 No. UP-5111)

For the purpose of creating favorable conditions for broad involvement of subjects of small business and private entrepreneurship in system of corporate purchases, first of all electronically, developments of the competition and ensuring transparency in case of their implementation, optimization of goods prices and services of subjects of natural monopolies:

1. Establish procedure according to which since May 1, 2013:

subjects of natural monopolies, the state unitary enterprises and economic societies with the state share in authorized fund more than 50 percent conduct procurement of separate types of goods (works, services) under one contract for the amount in equivalent from 300 US dollars to 100 thousand dollars of the USA by means of the electronic biddings on the separate trading floor organized by the Uzbek republican tovarnosyryevy exchange;

the inventory (works, services) which procurement is conducted by the subjects of natural monopolies, the companies and the organizations having the prevailing share of the state at the electronic auction held by the Uzbek republican commodity and raw exchange is determined by special Government commission;

the subjects of natural monopolies, the companies and the organizations having the prevailing share of the state place on special information portal of the Uzbek republican commodity and raw exchange and the newspaper "Exchange" information on the forthcoming purchases at least in 15 calendar days prior to date of determination of the supplier of goods (works, services), and also information on results of order placement within three days from the date of the conclusion of agreements (contracts), except as specified, stipulated by the legislation;

The Uzbek republican commodity and raw exchange provides open entry on special information portal to information on order placement, and also to the price information which developed following the results of realization of highly liquid types of goods in the exchange and off-exchange markets.

2. Create special Government commission on electronic procurement of subjects of the natural monopolies, companies and organizations having the prevailing share of the state in structure, according to appendix No. 1 it (is not brought).

Determine the main objectives of Government commission:

assistance to implementation of the international standards and standards in process of electronic procurement;

determination of Perechnya group of goods (works, services) which procurement is conducted by the subjects of natural monopolies, the companies and the organizations having the prevailing share of the state at the electronic auction held by the Uzbek republican commodity and raw exchange;

creating favorable conditions for further active and large-scale involvement of subjects of small business and private entrepreneurship in process of electronic procurement;

carrying out permanent monitoring of ensuring transparency when implementing electronic procurement, development and acceptance of necessary measures for stimulation of development of the competition and to enhancement of the legislation in this sphere.

Assign to the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition of function of working body of Government commission.

3. Approve Regulations on Government commission on electronic procurement of subjects of the natural monopolies, companies and organizations having the prevailing share of the state according to appendix No. 2.

4. To the state committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition together with the Uzbek republican commodity and raw exchange till May 1, 2013:

provide full functioning of separate trading floor for implementation of electronic corporate procurement in the online mode;

inform subjects of the natural monopolies, the companies and the organizations having the prevailing share of the state and subjects of entrepreneurship, including through mass media, rules of participation at the electronic biddings on the created trading floor.

5. Assign to heads of executive bodies of subjects of the natural monopolies, companies and organizations having the prevailing share of the state, the personal responsibility for ensuring transparency when implementing electronic procurement and fulfillment of requirements of this resolution.

6. Make changes and addition to some resolutions of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan according to  appendix No. 3.

7. To the state committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition together with the Ministry of Economics, the Ministry of Finance and the Ministry of Justice till May 1, 2013 to bring in the Cabinet of Ministers of the Republic of Uzbekistan:

Regulations on procedure for the organization and carrying out electronic procurement at the Uzbek republican commodity and raw exchange;

offers on the changes and amendments in the legislation following from this resolution.

8. To impose control of execution of this resolution on the Prime Minister of the Republic of Uzbekistan Sh. M. Mirziyoev.

Regulations on Government commission on electronic procurement of subjects of the natural monopolies, companies and organizations having the prevailing share of the state

I. General provisions

1. This Provision regulates activities of Government commission for electronic procurement of subjects of the natural monopolies, the companies and the organizations having the prevailing share of the state (further - Government commission), and determines its main objectives, functions, the rights and obligations.

2. Government commission is created for the purpose of further enhancement of system of electronic procurement at the level of the international standards and standards, development of the competition and increase in transparency when implementing electronic procurement, expansions of access for subjects of small business to the exchange biddings.

3. For the purpose of this provision electronic procurement are understood as process of acquisition by subjects of natural monopolies, the companies and the organizations having the prevailing share of the state, separate goods (works, services) during the electronic biddings on trading floor on corporate purchases of the Uzbek republican tovarnosyryevy exchange.

The inventory (works, services) which acquisition is performed by means of electronic procurement is determined by decisions of Government commission.
