About procedure and conditions of creation of structural divisions in state bodies and other state organizations

In pursuance of the paragraph of the fourth subitem 16.1 of Item 16 of the Presidential decree of the Republic of Belarus of April 12, 2013 No. 168 "About some measures for optimization of system of state bodies and other state organizations, and also the number of their workers" the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that:

1.1. state bodies and other state organizations which employees are government employees (further - state body), within the established number proceeding from conditions and regulations of controllability can be created if other is not established by the President of the Republic of Belarus, structural divisions on:

1.1.1. to levels of management:

the first level of management - structural divisions which heads submit directly to the head of state body or its deputy;

the second level of management - structural divisions which heads submit directly to the head of the structural unit of the first level of management or its deputy;

the third level of management - structural divisions which heads submit directly to the head of the structural unit of the second level of management or its deputy;

1.1.2. to types:

department (fund), committee (fund), head department (land management service), management (land management service), department (the press service, service of the state protocol, land management service), the sector - at the first level of management;

management, department, the sector - at the second level of management;

department, the sector - at the third level of management.

At the same time as a part of structural divisions of state bodies within the established number can be created:

in department (fund), committee (fund) - managements, departments, sectors;

1.2. the department (fund) is the structural division of state body created according to legal acts;

1.3. the committee (fund) is structural division regional and Minsk city executive committees and is created by the chairman of the relevant executive committee based on the Republic of Belarus of standard structure approved by the President regional, Minsk city, city (the cities of regional subordination), district executive committees, local administrations of areas in the cities (further - standard structure) numbering at least 21 established post of workers, including the head's position;

1.4. the head department (land management service) is the structural division enabling the realization of two and more main objectives and functions referred to competence of state body and (or) methodological and organizational management of the organizations subordinated to the relevant state body and is created by the head of the relevant state body (for local executive and administrative organs - taking into account standard structure) numbering at least 11 established posts workers, including the head's position;

1.5. management (land management service) is the structural division enabling the realization of one or several functions referred to competence of state body and is created by the head of the relevant state body on the first (for local executive and administrative organs - taking into account standard structure) and the second levels of management numbering at least 5 established posts of workers, including the head's position;

1.6. the department (the press service, service of the state protocol, land management service) is the structural division enabling the realization of one of the functions referred to competence of state body and is created by the head of the relevant state body on the first (for local executive and administrative organs - taking into account standard structure), the second and third levels of management numbering at least 3 established posts of workers, including the head's position;

1.7. the sector is the structural division enabling the realization of one function or its part carried to competence of state body and is created by the head of the relevant state body on the first (for local executive and administrative organs - taking into account standard structure), the second and third levels of management numbering at least 2 established posts of workers, including the head's position;

1.8. in territorial authorities of state bodies (their departments (funds) which are not their structural divisions and are not included in standard structure, by the head of the relevant state body or higher body managements, departments, sectors with observance of the conditions and regulations of controllability determined in subitems 1.5 - 1.7 presents of Item can be created;

1.9. the number of employees of separate structural divisions of the first level of management can be established less than the number provided in subitems 1.3-1.7 of this Item:

in regional and Minsk city executive committees according to legal acts or in coordination with Council of Ministers of the Republic of Belarus;

in city (the cities of regional subordination), district executive committees and local administrations of areas in the cities in coordination with regional and Minsk city executive committees;

1.9-1. the number of employees of departments of territorial authorities of forced execution can be established less than the number provided by subitem 1.6 of this Item;

1.10. in state bodies for the purpose of ensuring their activities and maintenance can be created:

services with observance of the conditions and regulations of controllability determined in subitem 1.5 of this Item;

departments with observance of the conditions and regulations of controllability determined in subitem 1.6 of this Item;

groups, laboratories, sites, offices, warehouses, bases, farms, bureau, archives, libraries, offices, expeditions with observance of the conditions and regulations of controllability determined in subitem 1.7 of this Item.

Except the structural divisions provided by part one of this subitem, the workers performing ensuring activities and maintenance of state bodies can be provided in staff lists (states) of state bodies both without creation of structural division, and in need of structure of structural division which workers are government employees.

Workers, the performing functions (obligations) treat the workers performing ensuring activities and maintenance of state bodies on:

to conducting document flow, including activities for maintaining archive, libraries, clerical works (except for performing the corresponding functions connected with protection of the state secrets);

to the linguistic analysis, editing texts of documents;

to conducting financial accounting and reporting;

to implementation of settlings with physical persons and legal entities;
