About approval of the Procedure for forming and maintaining the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine

According to the paragraph to the fifth Article part one 3, article 104 of the Law of Ukraine "About renewal of solvency of the debtor or recognition by his bankrupt", Items 3 and 9 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 395, I Order:

1. Approve the Procedure for forming and maintaining the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine which is applied.

2. To department of notariate, bankruptcy and functioning of the central zaveritelny body (Chizhmar K. I.) provide this order on state registration according to the Presidential decree of Ukraine of October 03, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes).

3. To provide to the state company "Information center" of the Ministry of Justice of Ukraine (Dobzhansky V. B.):

within two months from the date of entry into force of this order creation and implementation of the software of the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine;

within three months from the date of entry into force of this order creation and implementation of the website of the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine.

4. This order becomes effective from the date of its official publication.

Procedure for forming and maintaining the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine

I. General provisions

1.1. This Procedure is developed according to the paragraph the fifth parts one of Article 3 and part three of article 104 of the Law of Ukraine "About renewal of solvency of the debtor or recognition by his bankrupt" and determines procedure for forming, maintaining and use of data from the Unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine.

1.2. The unified register of arbitration managers (managers of property, managing directors of sanitation, liquidators) of Ukraine (further - the Unified register) is set of information about arbitration managers (managers of property, managing directors of sanitation, liquidators) Ukraine which received in the procedure established by the legislation the certificate on the right of conducting activities of the arbitration manager (the manager of the property managing sanitation, the liquidator), and information on their activities which the Ministry of Justice obtains in implementation process of the powers as state body concerning bankruptcy and from arbitration managers (managers of property, managing directors of sanitation, liquidators).

1.3. The unified register is created as a part of the Unified register of the companies concerning which proceeedings about bankruptcy are initiated.

1.4. The unified register is created on purpose:

maintaining in full accounting of the arbitration managers (managers of property, managing directors of sanitation, the liquidators) and also issued, renewed, the cancelled certificates on the right of conducting activities of arbitration managers (managers of property, managing directors of sanitation, liquidators) and their duplicates;

realization according to requirements of the legislation of the principles of availability, publicity and openness of information on arbitration managers (managers of property, managing directors of sanitation, liquidators) for the interested users;

forming of information on arbitration managers (managers of property, managing directors of sanitation, liquidators) and their activities necessary for the automated system for candidate screen on appointment of the arbitration manager as economic court on cases on bankruptcy (further - the Automated system).

1.5. The unified register contains:

1.5.1 registration number of record about the arbitration manager (the manager of property managing sanitation, the liquidator);

1.5.2 surname, name and middle name of the arbitration manager (the manager of the property managing sanitation, the liquidator);

1.5.3 date and number of the protocol of the decision of the qualification commission on passing an examination;

1.5.4 date and number of the order of the Ministry of Justice of Ukraine on issue of the certificate on the right to conducting activities of the arbitration manager (the manager of the property managing sanitation, the liquidator);

1.5.5 date of issue and certificate number about the right to conducting activities of the arbitration manager (the manager of the property managing sanitation, the liquidator);

1.5.6 data on assignment of skill level of arbitration managers (managers of property, managing directors of sanitation, liquidators);

1.5.7 date of issue and certificate number about passing of preparation on cases on bankruptcy of insurance companies, the term of its action;
