About approval of the Procedure for compensation to the Pension fund of Ukraine by fund of obligatory national social insurance of Ukraine on case of unemployment of expenses on payment to ahead of schedule granted pension and fee for its delivery

1. Approve the Procedure for compensation to the Pension fund of Ukraine by fund of obligatory national social insurance of Ukraine on case of unemployment of expenses on payment to ahead of schedule granted pension and fee for its delivery which is applied.

2. (M. Shambir) to provide to department of provision of pensions this order on state registration to the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

Procedure for compensation to the Pension fund of Ukraine by fund of obligatory national social insurance of Ukraine on case of unemployment of expenses on payment to ahead of schedule granted pension and fee for its delivery

1. This Procedure determines the mechanism of expense recovery, connected with pension payment to persons to whom they are appointed according to part one of article 49 of the Law of Ukraine "About employment of the population" and the Law of Ukraine "About obligatory national social insurance to unemployment case" ahead of schedule till January 01, 2015, and fee on their delivery (further - faces which are ahead of schedule granted pension).

2. To compensation the pension amounts paid during the period since date of their appointment, before date of achievement by person the stipulated in Clause 26 Laws of Ukraine "About obligatory national pension insurance" retirement age or age which grants the right to award of pension according to the Laws of Ukraine "About public service", "About the status of the People's Deputy of Ukraine", "About prosecutor's office", "About scientific and scientific and technical activities", taking into account stipulated by the legislation allowances, increases, target benefit, indexation, other surcharges to the pensions established by the legislation (except those which are compensated at the expense of means of the government budget) are subject, to the help on burial and the means spent by the Pension fund of Ukraine for delivery of the specified payments (further - expenses of the Pension fund).

Expense recovery of the Pension fund concerning the pensions appointed according to the Laws of Ukraine "About public service" "About the status of the People's Deputy of Ukraine", "About prosecutor's office", "About scientific and scientific and technical activities", for the period after achievement the stipulated in Clause 26 Laws of Ukraine "About obligatory national pension insurance" retirement age is performed in part which exceeds the pension size determined by the provisions of the law of Ukraine "About obligatory national pension insurance".

3. Expense recovery of the Pension fund is performed based on representation concerning money transfer of Fund of obligatory national social insurance of Ukraine on unemployment case (further - Fund) on expense recovery of the Pension fund of Ukraine for payment to ahead of schedule granted pension and fee for its delivery (further - representation) (appendix 1) and the list of persons which are ahead of schedule granted pension according to the Law of Ukraine "About employment of the population" (appendix 2) which are represented by head department of the Pension fund of Ukraine in the city of Kiev, by managements of the Pension fund of Ukraine in areas, the cities, areas in the cities, and also in the cities and areas (further - managements of the Pension fund) to 1 date in which payments are carried out, in corresponding managements of public service of employment in the area, the city, the area in the city or in the city and the area (further - management of public service of employment).

4. Financing to the relevant managements of public service of employment of expenses on expense recovery of the Pension fund in the amount of monthly need on these payments is performed by the central executive body which realizes state policy in the sphere of employment of the population and labor migration, to the 06th in which payments are carried out.

5. Within two working days after receipt of funds for the account the relevant management of public service of employment transfers funds to management of the Pension fund.
