About approval of the Standard regulations on children's home under corrective labor colony

(as amended on 24-04-2014)

According to Article 141 of the Penitentiary code of Ukraine and for the purpose of determination of the organization-legal principles of activities of children's home under corrective labor colony we ORDER:

1. Approve Standard regulations on children's home under corrective labor colony which are applied.

2. To department of interaction with authorities (Zerkal O. V.) to provide submission of this order on state registration according to the Presidential decree of Ukraine of October 03, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the vice-chairman of the Public penitentiary service of Ukraine and the deputy minister of health care of Ukraine according to distribution of obligations.

Standard regulations on children's home under corrective labor colony

І. General provisions

1.1. This Standard provision determines the organization-legal principles of activities of the children's home created under corrective labor colony in which the children under three years born by convicts to imprisonment by women, jointly with the mothers or separately from them are and raised.

1.2. The purpose of activities of children's home under corrective labor colony (further - children's home) is ensuring realization of the right of the child to the childhood, the conditions necessary for normal life activity and development of the child, stability and continuity of the relations of the child and mother.

1.3. The children's home is created and liquidated by the Public penitentiary service of Ukraine (further - GPTS) and submits to the chief of corrective labor colony.

1.4. The children's home in the activities is guided by the Constitution of Ukraine, the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, regulatory legal acts of the Ministry of Justice of Ukraine, the Ministry of Health of Ukraine, orders GPTS of the organizational ordering nature and this Standard provision.

1.5. The functional structure of children's home provides the organization of its activities for medical improving, psychology and pedagogical and administrative directions.

1.6. The children's home contains at the expense of the means of the government budget approved in the estimate of corrective labor colony in case of which the children's home, and other sources which are not prohibited by the legislation is created.

1.7. The structure and number of employees of children's home affirms the Chairman of GPTS during approval of number of employees of corrective labor colony.

The staff list affirms the head of territorial authority of management of GPTS within the assignments allocated for maintenance of institution.

1.8. Placement of children's home is performed based on constructions and rooms of fixed assets which are on balance of corrective labor colony.

1.9. Financial and economic activities, staffing and clerical work of children's home will be organized and performed according to the current legislation.

1.10. Control of quality of provision of the medico-public assistance to mothers and children who are in children's home observance of the sanitarnoprotivoepidemichesky mode is performed by territorial authority of management of GPTS and structural division of GPTS which is responsible for the organization of health care.

ІІ. Tasks of children's home

2.1. Creation of conditions for accommodation of children together with the condemned mothers and separately from them in premises of children's home.

2.2. Creation of conditions for development, education and training of children according to their age.

2.3. Ensuring stability and continuity of the relations of mother and child, assistance to development of the child, creation of conditions which provide game activities of children, their training, communication among themselves in children's home and beyond its limits.

2.4. Creation of conditions for free communication with children of the condemned women who did not express desire to live together with the child in children's home.

2.5. Education at the condemned women of responsibility for the child.

2.6. Assistance to acquisition by mothers who temporarily live in children's home, skills of independent life with the child.

2.7. Organization of medical, social and pedagogical and administrative activities of children's home.

2.8. Organization of provision of services of social, psychological, pedagogical, legal, economic, medical, household, information and other direction.

2.9. Ensuring the maximum preserving breastfeeding of children aged up to one year, their timely transfer into the mixed and artificial feeding.

2.10. Providing balanced diet of children aged from one up to three years.

2.11. Providing children and women with linen, clothes, footwear according to the regulations established by the order of the Ministry of Justice of Ukraine of February 20, 2012 No. 280/5 "About approval of the Procedure for providing with the material property and regulations of accessory of material property to convicts who serve sentence in organizations of execution of punishments and pre-trial detention centers" registered in the Ministry of Justice of Ukraine on February 21, 2012 for No. 261/20574.

2.12. Control of the state of health of children by medical personnel of children's home with involvement of doctors - specialists of pediatric profile.

2.13. Timely and complete laboratory inspection of sick children and children who arrive to children's home together with mother from pre-trial detention centers and other organizations of execution of punishments.

2.14. Daily medical observation of the pediatrician (other specialists) of children with entering of results of survey and psychophysical development of children in medical documentation.

2.15. The organization and carrying out profound preventive medical examination twice a year (in the spring and in the fall) with further inspection and treatment of children with the revealed pathology by their results.
