About approval of the Regulations on the plan of decrease in dumpings of pollutants, other substances and microorganisms in superficial water objects, underground water objects and on catchment areas

Approve the enclosed Regulations on the plan of decrease in dumpings of pollutants, other substances and microorganisms in superficial water objects, underground water objects and on catchment areas.

Regulations on the plan of decrease in dumpings of pollutants, other substances and microorganisms in superficial water objects, underground water objects and on catchment areas

1. This Provision establishes requirements to contents of the plan of decrease in dumpings of pollutants, other substances and microorganisms in superficial water objects, underground water objects and on catchment areas (further - the plan), procedure and terms of its approval, and also the basis for refusal in approval of the plan.

2. The plan is developed in case of impossibility of observance of standard rates of admissible dumpings of pollutants, other substances and microorganisms (further - standard rates) for establishment of limits on dumpings of pollutants, other substances and microorganisms (further respectively - limits on dumpings, dumpings) on condition of availability of the centralized systems of water disposal and objects of subscribers approved for objects which categories are determined by the Government of the Russian Federation according to part 1 of article 27 of the Federal law "About Water Supply and Water Disposal" (further - subscribers), standard rates of admissible dumpings.

3. The plan is developed by the organizations performing water disposal (further - the organizations), and also subscribers for the purpose of step-by-step achievement of the established standard rates on each substance on which the limit on dumpings is set.

4. Plans are developed for a period of up to 7 years. The organizations perform plan development according to the target indicators of sewage treatment approved in accordance with the established procedure and consider them in case of development of the investing programs.

5. The plan includes:

a) actions for decrease in dumpings - construction (including designing) new, reconstruction, upgrade and modernization of the operating systems of turnover and drainless water supply, systems of turnover and repeated and consecutive water supply, centralized and local treatment facilities, installations on purification of waste and (or) drainage waters, and also constructions on processing of deposit of sewage and collecting pipes (networks) for redirection of the crude sewage on treatment facilities;

b) data on the planned decrease in amounts (weight) in dumpings;

c) terms of accomplishment of actions for decrease in dumpings;

d) amount of expenses on implementation of actions on decrease in dumpings;

e) information about actionees of actions for decrease in dumpings of officials.

6. Actions for decrease in dumpings join in the plan consistently according to the procedure of their importance.

Criterion of the importance of the actions included in the plan is decrease in concentration, amount (weight) of the pollutants, other substances and microorganisms containing in composition of sewage.

7. The organizations approve the plan in coordination with authorized body of the executive authority of the subject of the Russian Federation, local government body of the settlement, city district and territorial authority of Federal Nature Management Supervision Service.

Subscribers approve the plan in coordination with territorial authority of Federal Nature Management Supervision Service.

8. The organizations and subscribers (further - applicants), represent to the bodies specified in Item 7 of this provision for the location of water object where dumping of sewage is performed:

a) statement for approval of the plan;

b) the plan (taking into account step-by-step achievement of the approved standard rates on each substance on which establishment of limit is planned for dumpings) in form according to appendix No. 1;

c) the report on the course of accomplishment of earlier approved plan - if to the applicant limits on dumpings, in form according to appendix No. 2 were already set.

9. Are specified in the statement for approval of the plan:

a) the information about the applicant - the full and abbreviated name, the location, individual taxpayer number;

b) period of implementation of the plan;

c) data on the approved standard rates, including the name of the authorized bodies which approved standard rates, the period of their action.

10. Documents, stipulated in Item the 8th this provision, are considered within 30 working days from the date of their receipt. If after the specified term notes to the plan are not provided, such plan is considered approved.

11. Demand from applicants of submission of the documents which are not provided by this Provision it is not allowed.

12. Documents, stipulated in Item the 8th this provision, can be provided directly or the registered mail with the assurance of receipt or in electronic form, signed by the digital signature, with use of information and telecommunication networks.

13. The basis for refusal in approval of the plan by authorized body of the executive authority of the subject of the Russian Federation is submission by the organization of data on unreasonable amount of expenses on implementation of actions for decrease in dumpings. The amount of expenses is unreasonable in the following cases:

a) discrepancy of the plan to the target indicators of organization activity approved in accordance with the established procedure;

b) construction expenses, reconstruction and upgrade of objects of centralized systems of water disposal are exceeded by the enlarged estimate standard rates for subjects to non-productive appointment and engineering infrastructure approved in accordance with the established procedure.

14. The basis for refusal in approval of the plan by local government body is discrepancy of the plan to the scheme of water supply and water disposal or the program of complex development of utility infrastructure of the respective municipality.

15. The bases for refusal in approval of the plan by territorial authority of Federal Nature Management Supervision Service are:

a) submission of documents not in full;

b) lack of the standard rates approved in accordance with the established procedure;
