About sports preparation

Chapter 1. General provisions

Article 1. Coverage of this Law

This Law extends to organizations of sports preparation, other sports organizations, irrespective of them organizationally legal forms, or the individual entrepreneurs performing sports preparation.

Article 2. Basic concepts

In this Law the following basic concepts are used:

- the program of sports preparation - the document developed for training of athletes according to requirements of state standards of sports preparation, establishing the main directions and conditions of sports preparation at each step;

- sports preparation - the purposeful activities for training of athletes for sports competitions by forming and enhancement of their sports skill performed according to requirements of state standards of sports preparation and programs of sports preparation;

- organization of sports preparation - the state and private non-profit organization which core activity is sports preparation and it is directed to program implementation of sports preparation;

- state standards of sports preparation of the sovokupnostrazrabotanny and approved requirements of sports preparation for sports (except for military and applied, office and applied and national sports), obligatory for the organizations performing sports preparation.

Article 3. Legislation of the Republic of Tajikistan on sports preparation

The legislation of the Republic of Tajikistan on sports preparation is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 4. The principles of state policy and the state sales warranties of the rights of citizens in the field of sports preparation

1. State policy in the field of sports preparation is based on the following principles:

- interaction of public authorities with the organizations of sports preparation, other sports organizations or individual entrepreneurs performing sports preparation;

- creation of conditions to organizations of sports preparation, other sports organizations, and also individual entrepreneurs for equal access to sports preparation;

- equal state support of organizations of sports preparation and other sports organizations, irrespective of their forms of business performing sports preparation;

- every possible assistance to development of activities of the public and private institutions of sports preparation;

- information and scientific support of sports preparation;

- ensuring availability of sports preparation to disabled people, persons with limited physical and mental capacities and others, persons equated to them according to the legislation of the Republic of Tajikistan.

2. The liberty of choice of sport, organizations of sports preparation, other sports organizations performing sports preparation is guaranteed to citizens.

3. The procedure, form and amount of the state support of activities of the public sports organizations are established by the Government of the Republic of Tajikistan.

Chapter 2. The organization of activities in the field of sports preparation

Article 5. Subjects of the sphere of sports preparation

Treat subjects of the sphere of sports preparation:

- authorized state body in the field of sports preparation (further - authorized state body);

- local authorized body of the government in the field of sports preparation;

- the organizations of sports preparation, other sports organizations performing sports preparation;

- the scientific and medical organizations which activities are connected with ensuring sports preparation;

- the athletes having sports training in the organizations of sports preparation and other sports organizations performing sports preparation;

- the staff of organizations of sports preparation, including the trainers and other specialists of the sphere of physical culture and sport determined according to regulatory legal acts of the Republic of Tajikistan;

- the individual entrepreneurs performing sports preparation.

Article 6. Powers of authorized state body

In the field of sports preparation the authorized state body has the following powers:

- development of state programs of sports preparation and their submission for approval to the Government of the Republic of Tajikistan;

- realization of state policy in the field of sports preparation;

- the organization of sports training of athletes and candidates for national teams of the Republic of Tajikistan for sports according to the procedure, established by the legislation of the Republic of Tajikistan;

- approval of the program of sports preparation based on offers of sports federations and organizations of sports preparation;

- development and approval of state standards;

- organization of professional training, retraining and advanced training of employees (trainers) of the sphere of sports preparation;

- carrying out certification and assignment of qualification categories and ranks to employees (trainers) and heads of public institutions of sports preparation;

- financial, material logistics, including sports equipment and equipments;

- scientific and methodical and medical support;

- control of prohibition on use of stimulators and doping substances in sport;

- the organization of scientific research in the field of sports preparation;

- establishment of procedure of control of activities of organizations of sports preparation and other sports organizations performing sports preparation;

- providing the state sales warranties of the rights of citizens in the field of sports preparation;

- implementation of other powers determined by the legislation of the Republic of Tajikistan.

Article 7. Powers of local executive bodies of the government and self-government institutions of settlements and villages in the field of sports preparation

In the field of sports preparation enters powers of local executive bodies of the government and self-government institutions of settlements and villages:

- realization of state policy in the field of sports preparation on places;

- the organization of sports training of athletes - members of local sports national teams;

- creation of local organizations of sports preparation, their financial and material logistics;

- assistance of activities of subjects of the sphere of sports preparation on places;
