About approval of the Main directions of prevention of homelessness till 2017

Cabinet of Ministers of Ukraine decides:

1. Approve the Main directions of prevention of homelessness till 2017 which are applied.

2. To the ministries, other central executive bodies, Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city public administrations:

consider the Main directions approved by this resolution during implementation of the activities connected with accomplishment of programs of economic and social development and acts of the legislation concerning realization of the state economic and social policy;

provide each half a year to the Ministry of social policy information on condition of accomplishment of this resolution on the form approved by the Ministry.

3. To the ministry of social policy to inform twice a year till January 25 and on July 25 the Cabinet of Ministers of Ukraine on condition of accomplishment of this resolution.

4. Recognize invalid acts of the Cabinet of Ministers of Ukraine according to the list which is attached.

The main directions of prevention of homelessness till 2017

General part

The main directions determine the priority tasks of executive bodies concerning prevention of homelessness directed to realization by homeless persons of the rights and freedoms provided by the Constitution and the laws of Ukraine, creation of conditions for activities of public associations in the sphere of social protection of the population.

State regulation in the sphere of social protection of homeless persons is performed taking into account such principles:

individual approach;

focus and targeting of provision of social services;

providing social guarantees;

tolerance;

confidentiality;

realization of basic rights and freedoms;

inspection of living conditions of homeless persons, and also choice of forms and methods of social work;

coordination of actions of executive bodies, public associations in the solution of questions of social protection of homeless persons.

The main directions are developed taking into account the principles of the state economic and social policy for the medium-term period determined by the Program of economic reforms for 2010-2014 "Prosperous society, competitive economy, the effective state", other acts of the legislation concerning social and economic development.

Problems which need the decision

One of the main problems which need the decision for prevention of homelessness is ensuring development of network of institutions for homeless persons whose number for this time makes 91 institution, from them 62 institutions are created by local executive bodies or local government bodies and 29 institutions - public associations.

During 2002-2012 such categories of homeless persons are revealed:

persons who suffered from human trafficking, catastrophic crashes and accidents;

migrants;

disabled people;

persons of retirement age;

persons who served sentence in the form of restriction of freedom or imprisonment for certain term;

persons who lost housing in connection with the family circumstances connected with the conflicts and violence in family.

Persons who treat risk groups concerning loss of housing or the right to its use, in particular the orphan children and children deprived of parent care inhabitants of hostels for which such housing is the single residence persons who have no own housing need special attention and live in leased rooms, acquaintances, relatives, friends, and also person who suffer on the mental disturbances sick with drug addiction and chronic alcoholism, incapacitated and restrictedly capable persons.

By results of social population analysis most of homeless persons are faces of working-age, have basic or complete general or vocational training or are skilled workers, have no identity documents that makes impossible registration of their residence or stay and, as a result, deprives of possibility of capture them on accounting in Public service of employment, registration of pension in the Pension fund of Ukraine and/or receipt of the appropriate public assistance, and also make social threat of spread of such diseases as tuberculosis, hepatitis, HIV/AIDS, etc. as the condition of their health is unsatisfactory.

Priority tasks of state regulation in the sphere of social protection of homeless persons

Priority tasks of state regulation in the sphere of social protection of homeless persons are:

in the direction of forming of system of prevention of homelessness

enhancement of the legislation for the purpose of providing the rights to housing of persons from risk groups concerning loss of housing or the right to its use;

activization of work of local executive bodies on prevention of illegal alienation of housing, including living space which belongs to children;

observance by notaries of the requirements established by the legislation concerning the conclusion of the agreements connected with alienation of housing, and issue of powers of attorney concerning removal from registration accounting of citizens at the place of residence;

implementation of actions for assistance to persons who suffered from violence in family or human trafficking;

treatment and support of persons who suffer on mental disturbances are sick with drug addiction and chronic alcoholism;

establishment of guardianship over incapacitated is also limited by capable persons;

enhancement of regulatory legal acts and activities central and local executive bodies, local government bodies concerning guardianship and leaving over incapacitated is also limited by capable persons;

protection and support of lonely citizens of advanced years and disabled people;

providing rights of inhabitants of hostels;

protection of housing, property and other laws:

- the orphan children and children deprived of parent care who are raised in residential institutions;

- persons exempted from serving sentence in the form of restriction of freedom or imprisonment for certain term;

the solution of social questions of persons who served sentence in the form of restriction of freedom or imprisonment for certain term, in particular providing them with housing or temporary haven;

assistance to registration to the condemned persons who prepare for release from places of detention and restriction of freedom, the passport of the citizen of Ukraine;

provision to the condemned persons who prepare for release from places of detention and restriction of freedom, financial support according to the legislation;

control of observance by foreigners and persons without citizenship who live or there are in Ukraine, legislations on legal status of foreigners and stateless persons;

enhancement of activities of supervisory committees and implementation of actions for preserving housing of persons who serve sentence in the form of restriction of freedom or imprisonment, provision of housing or temporary haven of persons exempted from serving sentence in the form of restriction of freedom or imprisonment for certain term;
