About measures for realization of separate provisions of the Federal Law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income"

1. Determine that the Head of Administration of the President of the Russian Federation or the official of Administration of the President of the Russian Federation who is specially authorized by him based on article 5 of the Federal Law of December 3, 2012 No. 230-FZ "(Further - the Federal Law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income") makes the decision on control of expenses on control of compliance of expenses of persons replacing the state positions, and other persons to their income":

a) persons replacement:

the state positions of the Russian Federation concerning which the Federal constitutional Laws or the Federal Laws do not establish other procedure of control of expenses;

position of the board member of the Central bank of the Russian Federation and position of vice-chairmen of the Central bank of the Russian Federation;

positions of the Federal State Service, appointment to which and release from which are performed by the President of the Russian Federation or on representation of the President of the Russian Federation;

positions of the first deputy and deputy attorneys general of the Russian Federation, appointment to which and release from which are performed on representation of the Prosecutor General of the Russian Federation;

positions of heads and deputy managers of the Office of the Federation Council of Federal Assembly of the Russian Federation, State Duma administration of Federal Assembly of the Russian Federation, office of Russian Central Election Commission and office of Audit Chamber of the Russian Federation;

positions in the state corporations (companies), appointment to which and release from which are performed by the President of the Russian Federation;

positions in other organizations created based on the Federal Laws, appointment to which and release from which are performed by the President of the Russian Federation;

separate positions based on the employment contract in the organizations created for accomplishment of the tasks set for federal state bodies, appointment to which and release from which are performed by the President of the Russian Federation;

position of the ataman of the army Cossack society entered in the state register of the Cossack societies in the Russian Federation;

position of the chief financial representative;

b) the spouse (spouses) and minor children of persons replacing the positions specified in the subitem "an" of this Item.

2. Determine that the Deputy Prime Minister of Russia - the Chief of staff of the Government of the Russian Federation based on article 5 of the Federal law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income" makes the decision on control of expenses:

a) persons replacement:

positions of the Federal State Service, appointment to which and release from which are performed by the Government of the Russian Federation;

positions in the state corporations (companies), appointment to which and release from which are performed by the Government of the Russian Federation;

positions in the Pension Fund of the Russian Federation, Social Insurance Fund of the Russian Federation, Federal Compulsory Health Insurance Fund, appointment to which and release from which are performed by the Government of the Russian Federation;

positions in other organizations created based on the Federal Laws, appointment to which and release from which are performed by the Government of the Russian Federation;

separate positions based on the employment contract in the organizations created for accomplishment of the tasks set for federal state bodies, appointment to which and release from which are performed by the Government of the Russian Federation;

b) the spouse (spouses) and minor children of persons replacing the positions specified in the subitem "an" of this Item.

3. Determine that the head of federal state body, the management official (the head of the supreme executive body of the government) of the subject of the Russian Federation, the Chairman of the Central bank of the Russian Federation, the head of the state corporation (company), Pension Fund of the Russian Federation, Social Insurance Fund of the Russian Federation, Federal Compulsory Health Insurance Fund, other organization created based on the Federal Laws, or the officials authorized by them accept based on article 5 of the Federal law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income" the decision on control of expenses of the corresponding persons within the established competence.

3.1. Data on expenses represent faces, replacement positions which replacement involves obligation to represent data on the income, on property and obligations of property nature, and also data on the income, on property and obligations of property nature of the of the spouse (spouse) and minor children.

4. Determine that based on article 6 of the Federal law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income":

a) Management of the President of the Russian Federation concerning anti-corruption exercises control of expenses of persons specified in Item 1 of this Decree;

b) the division of the Russian Government Office determined by the Government of the Russian Federation exercises control of expenses of persons specified in Item 2 of this Decree;

c) bodies, divisions or the officials responsible for work on prevention of corruption and other offenses specified in parts 2 - the 5th article 6 of the Federal law "About Control of Compliance of Expenses of Persons Replacing the State Positions, and Other Persons to Their Income", exercise control of expenses of the corresponding persons within the established competence.
