About measures for further enhancement of activities of Department for execution of judgments, material and financial provision of activity of the courts under the Ministry of Justice of the Republic of Uzbekistan

For the purpose of ensuring unconditional execution of judgments, further increase in efficiency of activities of Department for execution of judgments, to material and financial provision of activity of the courts under the Ministry of Justice of the Republic of Uzbekistan (further - Judicial department), strengthenings of its personnel potential, enhancement of system of material work incentives of legal executives:

1. Enter, taking into account complexity, amounts and effectiveness of the performed works, the system of categorization of district (city) departments of legal executives including departments of legal executives of the first, second and third category.

At the same time to determine that:

city departments, and also district departments of legal executives with annual average amount of executive documents over 15 thousand units serving the territory with the population exceeding 250 thousand people treat departments of legal executives of the first category;

district departments of legal executives with annual average amount of executive documents over 8 thousand units and serving the territory with the population from 100 thousand to 250 thousand people treat departments of legal executives of the second category;

other departments of legal executives belong to the third category.

Approve the list of kategorirovanny departments according to appendix No. 1.

2. Since January 1, 2013:

raise job grades of compensation of legal executives of district (city) departments of the first category on 2 job grades, the second category - on 1 job grade, according to appendix No. 2;

establish the sizes of monthly allowances to official pay rates of legal executives for effectiveness of work on return to the income of the state of the means collected according to executive documents according to appendix No. 3.

Determine that payment to legal executives of allowances for effectiveness of work is performed by fund of development of courts and judicial authorities.

3. Accept offers of the Ministry of Justice and the Ministry of Finance of the Republic of Uzbekistan:

about redistribution of number of district (city) departments of legal executives by the translation of 160 positions of legal executives from areas with rather smaller loading to the areas having bigger amount of enforcement proceedings;

about optimization of number of central office and territorial (regional) administrations by reducing 28 duplicative and excessive positions with the direction of the released units on strengthening of organizational examination and clerical work in territorial (regional) administrations of Judicial department;

about strengthening of local divisions of Judicial department, providing introduction in structure of district (city) departments of legal executives of 1 unit of the secretary-report clerk, in territorial (regional) managements of Judicial department - on 1 unit of the registrar.

Determine that the expenses connected with introduction of position of the registrar and secretary-report clerk become covered by fund of development of courts and judicial authorities.

4. Due to the assignment on Judicial department of functions of inquiry on the cases entering according to the legislation its competence to create:

in central office of Judicial department - department of inquiry and administrative practice numbering managerial personnel 3 units;

in territorial (regional) administrations of Judicial department - sectors of inquiry in structure to three investigators in everyone and with the total number of managerial personnel of 34 units.

Determine that the created divisions of Judicial department on inquiry and administrative practice are completed at the expense of means of the Government budget.
