1. Approve enclosed:

1) Rules of state registration of space objects and rights to them;

2) form of the register of space objects.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of state registration of space objects and rights to them

1. General provisions

1. These rules of state registration of space objects and rights to them (further - Rules) are developed according to the subitem 17) of article 8 of the Law of the Republic of Kazakhstan of January 6, 2012 "About space activities" and determine procedure of state registration of the space objects of scientific, social and economic and dual purpose (further - space objects) belonging to physical persons or legal entities of the Republic of Kazakhstan and the rights to them and also the space objects belonging to foreign physical persons or legal entities, started in space from the territory of the Republic of Kazakhstan.

2. Space objects are subject to state registration:

1) belonging to physical persons or legal entities of the Republic of Kazakhstan, and also it is right on these space objects;

2) belonging to foreign physical persons or legal entities, started in space from the territory of the Republic of Kazakhstan.

3. State registration of space objects and rights to them specified in the subitem 1) of Item 2 of these rules is understood as accounting of space objects, the act of recognition and confirmation by the state of origin, change or termination of the rights (encumbrance of the rights) to space object according to the civil legislation of the Republic of Kazakhstan.

State registration of the space objects specified in the subitem 2) of Item 2 of these rules is understood as entry in the register of space objects without state registration of the rights to them.

 4. State registration of space objects and rights to them is performed by authorized body in the field of space activities (further - authorized body).

5. For state registration and issue of the duplicate of the certificate on state registration collection according to the procedure and the sizes determined by the tax legislation of the Republic of Kazakhstan is levied.

2. Procedure for state registration of space objects and rights to them

6. For state registration of space object and the rights to it the following documents are submitted to authorized body:

1) the statement of the established form according to appendix 1 to these rules;

2) the copy of the title document on space object (notarially attested in case of non-presentation of the original for reconciliation);

3) the copy of the license for the right of implementation of activities in the sphere of use of space (notarially attested, in case of non-presentation of the original for reconciliation);

4) the document confirming payment in the budget of the amount of collection for state registration of space object and the rights to it.

7. State registration of space objects and rights to them specified in the subitem 1) of Item 2 of these rules is made in the following procedure:

1) documents acceptance, stipulated in Item 6 these rules when which obtaining the official of authorized body makes the corresponding record in the book of accounting of incoming documents.

By provision of incomplete document package, necessary for state registration, the applicant is given the motivated written answer about refusal in state registration no later than three working days from the date of their receipt in time. By provision of documents by the applicant purposely the motivated written answer about refusal in state registration is issued to the applicant immediately;

2) verification of the documents submitted on state registration, establishment of lack of contradictions between the declared rights and already registered rights to this space object and also the bases for refusal in state registration;

3) issue of the certificate on state registration of space object according to appendix 2 to these rules or the document on refusal in state registration on the bases specified in Item 13 of these rules.

After implementation of state registration of space objects and rights to them specified in the subitem 1) of Item 2 of these rules, the authorized body makes the corresponding entry in the register of space objects.

8. State registration of space objects and rights to them, entering of record into the register of the space objects confirming the fact of destruction or utilization of space object and also issue of the duplicate of the certificate on state registration is made within fifteen working days from the date of receipt of the statement in authorized body.

9. State registration of encumbrances of the rights imposed by state bodies and other authorized persons and in other cases when such encumbrances of the rights are established not on declaration of will of the owner is made immediately from the moment of receipt of the relevant document in authorized body.

When the rights (encumbrance of the rights) arise based on the transaction certified in notarial procedure, registration is performed according to the statement of any party (participant) of the transaction with application of a copy of the document containing encumbrance of the right to space object (notarially attested, in case of non-presentation of the original for reconciliation).

10. State registration of encumbrances of the rights to space objects specified in the subitem 1) of Item 2 of these rules is made in the following procedure:
