Regulations on military transport obligation

I. General provisions

1. The military transport obligation is established for timely, high-quality and in full providing Armed Forces of the Republic of Tajikistan with vehicles, other troops, military forming and bodies, and also created on wartime of special forming (further hereinafter are referred to as - troops, forming and bodies) during mobilization and in wartime.

In this Provision vehicles are understood as the rail, air, road, animal and pack transport, motorcycles, tractors, road-building, hoisting-and-transport and other machines and mechanisms.

2. The military transport obligation is constituent of mobilization preparation and mobilization in the Republic of Tajikistan and consists in holding the actions connected taking into account, advance preparation and provision of vehicles to troops, forming and bodies and also in ensuring work of these vehicles.

In this Provision provision of vehicles is understood as their delivery, transfer and use for the benefit of troops, forming and bodies.

3. The military transport obligation extends on:

ministries and departments of the Republic of Tajikistan;

bodies of the executive government on places and local self-government in the settlement and the village;

the organizations irrespective of pattern of ownership, being owners of vehicles, the organizations owning vehicles on the right of economic maintaining, operational management or on other basis provided by the law or the agreement and also on the organizations ensuring functioning of vehicles, including the airports, petroleum storage depots, transshipment facilities of fuel, gas stations, repair and other organizations (further hereinafter are referred to as - the organizations);

citizens - owners of vehicles (citizens hereinafter are referred to as further).

The military transport obligation does not extend to diplomatic representations and consular establishments of foreign states, the foreign and international organizations, foreign citizens and persons without citizenship.

II. Procedure for execution of military transport obligation by the ministries and departments of the Republic of Tajikistan, public authorities on places and local self-government, the organizations

4. The military transport duty is fulfilled by the ministries and departments of the Republic of Tajikistan, actuators of the government on places and local self-government, the organizations:

in peace time - by holding the actions connected taking into account vehicles and also by advance preparation of the vehicles provided to troops, forming and bodies and ensuring work of these vehicles, according to mobilization tasks;

during mobilization and in wartime - by provision to troops, forming and bodies - vehicles and ensuring their work according to mobilization tasks.

5. For the purpose of execution of military transport obligation mobilization tasks, percentage regulations and limits of the provided vehicles are set:

to the ministries and departments of the Republic of Tajikistan, executive bodies (hukumat). The Gorno-Badakhshan Autonomous Region and areas, the city of Dushanbe, the cities and areas of republican subordination - the Government of the Republic of Tajikistan;

to bodies of the executive government on places and local self-government - chairmen of the Gorno-Badakhshan Autonomous Region, areas and the city of Dushanbe. The specified bodies provide execution of military transport obligation by the organizations which are in their territories.

6. Lists of the vehicles provided to troops, forming and bodies are established by the Ministry of Defence of the Republic of Tajikistan.

7. Accounting of vehicles according to lists, stipulated in Item the 6th this provision, is assigned on district and city (without district division) military commissariats (further hereinafter are referred to as - military commissariats) and to General staff of Armed Forces of the Republic of Tajikistan.

The accounting treatment for the specified vehicles is determined by the Ministry of Defence of the Republic of Tajikistan in coordination with the bodies performing state registration of vehicles.

8. Check of technical condition of the vehicles provided to troops, forming and bodies is carried out by divisions of the State automobile inspection of the Ministry of Internal Affairs of the Republic of Tajikistan and other state supervision bodies and control of technical condition of vehicles of the Republic of Tajikistan with participation of representatives of troops, forming and bodies.

9. The list of owners of the vehicles exempted from provision of vehicles is established by the Government of the Republic of Tajikistan.

10. Preparation and ensuring work of the vehicles provided to Armed Forces of the Republic of Tajikistan, other troops, forming and bodies is performed by the ministries and departments of the Republic of Tajikistan, public authorities on places and local self-government, the organizations and includes accomplishment of actions and mandatory requirements on ensuring mobilization readiness of the specified vehicles according to this Provision and other regulatory legal acts of the Republic of Tajikistan concerning military transport obligation.

11. The list of actions and mandatory requirements, and also document forms determining mobilization readiness and ensuring work of the vehicles provided to troops, forming and bodies are determined by the Ministry of Defence of the Republic of Tajikistan in coordination with the Ministry of Economy and Trade of the Republic of Tajikistan and the Ministry of Finance of the Republic of Tajikistan with participation of other interested ministries and departments.

On the questions requiring the solution of the Government of the Republic of Tajikistan, offers are made by the Ministry of Defence of the Republic of Tajikistan in accordance with the established procedure.

12. For ensuring mobilization readiness of the vehicles provided to troops, forming and bodies, the organizations shall perform:

selection of vehicles together with representatives of troops, forming and bodies;

content of vehicles in ready mode to provision to troops, forming and bodies;

preparatory activities for installation on vehicles of the special equipment, accumulating, storage and updating of inventories of material values of mobilization reserve and other property according to mobilization tasks;

verification of presence and technical condition of vehicles according to requirements of the existing instructions and rules;

LOC ARM checks to ensuring work of vehicles;

representation to troops, forming and bodies of information on availability and technical condition of vehicles:
