1. Approve the enclosed Rules of confirmation of authenticity of the foreign electronic digital signature by the confidential third party of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of confirmation of authenticity of the foreign electronic digital signature by the confidential third party of the Republic of Kazakhstan

1. General provisions

1. These rules of confirmation of authenticity of the foreign electronic digital signature by the confidential third party of the Republic of Kazakhstan (further - Rules) are developed according to subitem 4-2) of article 4 of the Law of the Republic of Kazakhstan of January 7, 2003 "About the electronic document and the electronic digital signature" (further - the Law).

Rules determine procedure for confirmation of authenticity of the foreign electronic digital signature by the confidential third party of the Republic of Kazakhstan with participants of information exchange.

2. In these rules the following basic concepts are used:

1) the confidential third party of the Republic of Kazakhstan (further - DTS RK) - the public technical service performing confirmation of authenticity of the foreign electronic digital signature with use of means of the electronic digital signature (the means of cryptographic information protection realizing processes of forming and verification of the electronic digital signature);

2) the electronic digital signature (further - the EDS) - set of electronic digital characters created by means of the electronic digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

3) RFC 3029 (Internet X.509 Public Key Infrastructure Data Validation and Certification Server Protocols (DVCS)) - the protocol on the basis of which the integrated information system of foreign and mutual trade of the Customs Union in case of cross-border information exchange is under construction;

4) certification center - the legal entity certifying compliance of public key of the electronic digital signature to private key of the electronic digital signature, and also confirming reliability of the registration certificate;

5) the registration certificate - the paper document or the electronic document issued by the certification center for confirmation of conformity of the electronic digital signature to requirements established by the Law;

6) the registration certificate of certification center - the self-signed registration certificate of certification center;

7) the receipt of verification of the foreign digital signature (further - the receipt DVC under the DVCS protocol of service of "Electronic notariate" (RFC 3029)) - the electronic document certified by the EDS of DTS RK and confirming authenticity of the foreign EDS;

8) VSD (Validation of Digitally Signed Document) - the service DTS RK performing check of authenticity of the foreign EDS;

9) VPKC (Validation of Public Key Certificates) - the service DTS RK performing check of accessory and reality of public key of the electronic digital signature of one or several registration certificates.

3. Participants of information exchange with DTS RK are:

1) DTS of foreign states;

2) physical persons and legal entities (further - users).

2. Procedure for confirmation of authenticity of the foreign electronic digital signature

4. DTS RK verifies authenticity of the foreign electronic digital signature in case of accomplishment of the following conditions:

1) the checked electronic document is certified by the electronic digital signature of physical person or legal entity of foreign state;

2) the registration certificate of physical person or legal entity of foreign state is issued in foreign certification center;

3) the foreign certification center is registered in the relevant DTS of foreign state;

4) DTS of foreign state is registered in DTS RK.

Registration procedure of DTS of foreign state in DTS RK is determined by authorized body in the field of informatization.

5. For check of authenticity of the foreign electronic digital signature the user by means of the www.dts.gov.kz Internet resource (further - Internet resource) sends to DTS RK the following electronic inquiries (by the commitment form on service and answer form by the DVCS protocol of service of "Electronic notariate") according to RFC 3029:

1) VSD (Validation of Digitally Signed Document) - for check of authenticity of the foreign EDS;

2) VPKC (Validation of Public Key Certificates) - for check of accessory and reality of public key of the electronic digital signature of the foreign registration certificate.

6. The structure declaration of electronic request and the answer is given in appendix to these rules.

7. DTS RK on the basis of the received requests performs their check, at the same time redirects requests to the relevant DTS of foreign state in which the checked registration certificate was issued.

8. Based on the received answer from DTS of foreign state of DTS RK creates the answer in the form of the receipt DVC, being authenticity of the foreign EDS, necessary and sufficient for confirmation, in the territory of the Republic of Kazakhstan.

9. Confirmation of authenticity of the foreign EDS of DTS RK is performed in the round-the-clock online mode on free basis through Internet resource.

10. Types of answers from DTS RK:

1) the receipt DVC with the status "Is checked" It (is confirmed);

2) the receipt DVC with the status "Is not checked" it (is not confirmed);

3) the receipt DVC with the status "Cannot be checked" (It is not decrypted, error, failure).

Confirmation of authenticity of the foreign EDS is considered certified, in case of receipt DVC availability with the status "Is checked", received by the user from DTS RK in the online mode on Internet resource.

11. DTS RK stores information on the received requests in the database, using unique identifiers of transactions within one calendar year.
