About approval of the Procedure for compensation to employers of part of the actual expenses connected with payment of single fee on obligatory national social insurance

(as amended on 05-02-2020)

According to part three of article 24 of the Law of Ukraine "About employment of the population" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for compensation to employers of part of the actual expenses connected with payment of single fee on obligatory national social insurance which is applied.

Procedure for compensation to employers of part of the actual expenses connected with payment of single fee on obligatory national social insurance

1. This Procedure determines conditions, the payment mechanism regional, Kiev city, city, district and district jobcenters (further - jobcenters) compensations to the employer of actual expenses in the amount of 50 percent of the amount of the assessed single contribution on obligatory national social insurance for each person employed on new workplace (further - compensation), at the expense of the means of the government budget provided in the budget of Fund of obligatory national social insurance of Ukraine on unemployment case (further - Fund).

In this Procedure terms are used in the value given in the Laws of Ukraine "About state registration of legal entities, physical persons - entrepreneurs and public forming", "About collection and accounting of single fee on obligatory national social insurance", "About employment of the population", other acts of the legislation.

2. Action of this Procedure extends to employers (subjects of managing) who since 2013:

create new workplaces and employ on them workers by execution of an employment agreement;

during 12 calendar months from the date of execution of an employment agreement with person employed on new workplace monthly perform payment of the salary to it in the amount of at least three minimum wage.

If the employer provided observance of the requirements provided by this Item, he acquires entitlement to compensation of actual expenses in the amount of 50 percent of the amount of the assessed single contribution for obligatory national social insurance (further - single fee) during the following 12 calendar months on condition of preserving the salary level in the amount of at least three minimum wage in month of payment of single fee for person employed on new workplace.

In case of reduction of the number of staff of workers and the salary fund the employer loses entitlement to compensation.

For confirmation of the facts of lack of reduction of the number of staff of workers and the salary fund the average number of staff employees and the size of the salary fund in month in which such facts are checked are compared to average value of average number of staff employees and average value of the salary fund in 12 months preceding month of check of indicators, respectively.

3. Action of this Procedure does not extend to employers who are the subjects of managing created as a result of the termination of other legal entity within 12 months which preceded creation of new workplace, and budgetary institutions.

4. Information on education of the subject of managing, in particular as a result of the termination of other legal entity, is confirmed by data from the Unified State Register of Legal Entities, the physical persons entrepreneurs and public forming which arrived in jobcenters as a result of exchange of information.

5. For receipt of compensation the employer monthly within the next 12 months from the date of execution of an employment agreement with person employed on new workplace submits to jobcenter the certificate of accomplishment by the employer of compensation conditions of part of the actual costs connected with payment of single fee on obligatory national social insurance (further - the reference), in form according to appendix.

6. The jobcenter not later than in five working days from the date of receipt of the reference sends to territorial authority of Gostrud the appeal about confirmation of information specified in it.

The territorial authority of Gostrud informs from the date of receipt of the address the relevant jobcenter on results of its consideration in a month.

The pension fund of Ukraine on request of the State jobcenter provides such information from the register insured persons of the State register of obligatory national social insurance:

about employment relationships with person employed on new workplace, for the period, specified in request (date of creation of new workplace and start date of employment relationships);

about the amounts of accrued payroll to persons employed on new workplace, for the period, specified in request, and the amount of the assessed single contribution.

The specified information is provided by the Pension fund of Ukraine in electronic form in a month from the date of receipt of request from the State jobcenter.

The state jobcenter transfers this information to jobcenters for decision making about compensation payment.

7. The jobcenter within 10 calendar days after receipt of information from territorial authority of Gostrud and the Pension fund of Ukraine makes the decision on compensation payment, creates the request for the need for funds for payment of compensation and gives to organization under which supervision he is.

8. Payment of compensation is performed based on information obtained from territorial authorities of Gostrud and the Pension fund of Ukraine, monthly during 12 calendar months after completion of the same period from the date of execution of an employment agreement with person employed on new workplace by money transfer from the account of Jobcenter on the bank account of the employer specified in the reference.

9. The entitlement to compensation remains for the employer also in case the employment contract with person employed on new workplace is broken off and concluded with other person employed on this workplace provided that the salary level in one calendar month constituted at least three minimum wage in month of payment of single fee totally according to such employment contracts.

10. The state jobcenter monthly based on the received applications for the need for funds for payment of compensation directs to Ministry of Economics idea of money transfer into the account of Fund for compensation payment (further - representation) in the form approved by Ministry of Economics.
