1. This Instruction determines conditions and procedure for performing voluntary medical examination and obligatory medical examination for the purpose of establishment of availability or absence at the patient of the diseases constituting health hazard of the population, human immunodeficiency virus, determination of its needs in medical care.
2. In this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus of January 7, 2012 No. 345-Z "About the prevention of spread of diseases, constituting health hazard of the population, human immunodeficiency virus are applied".
3. Voluntary medical examination is carried out in the organizations of health care of all patterns of ownership having the license for implementation of medical activities, except as specified stipulated by the legislation about licensing in case of which receipt of the license for implementation of medical activities is not required.
Obligatory medical examination is carried out in the state organizations of health care.
4. Obligatory medical examination is performed concerning the persons specified in part three of article 16 of the Law of the Republic of Belarus "About the prevention of spread of diseases, constituting health hazard of the population, human immunodeficiency virus".
5. For challenge of person which is subject to obligatory medical examination, the state organization of health care the notice in writing on challenge for passing of obligatory medical examination for the purpose of establishment of availability or absence at the patient of the diseases constituting health hazard of the population, human immunodeficiency virus (further - HIV) in form according to appendix goes (further - the notice).
6. The notice is drawn up by the specialist doctor of the state organization of health care concerning person which is subject to obligatory medical examination based on studying of medical documents, epidemiological and clinical data.
7. The notice is handed personally under the signature to person who is subject to obligatory medical examination in the place of his residence (the place of stay) in the presence of one or several witnesses.
The fact of service of notice is drawn up by the act which is signed by person who handed the notice and the witness (witnesses).
8. In case of lack of possibility of service of notice personally it goes by mail the registered mail with the notification to the terms sufficient for advance receipt of the notice by person who is subject to obligatory medical examination till the established time of obligatory medical examination.
9. Data on execution of the notice, the reason of performing obligatory medical examination, the mail notification or the act of delivery are introduced in medical documents of person which is subject to obligatory medical examination.
10. When performing voluntary medical examination and obligatory medical examination the patient is informed on need and value of the carried-out medical examination and possible consequences according to the received results.
11. In the organization of health care information on possibility of passing of voluntary medical examination (including anonymously) and obligatory medical examination on detection of the diseases constituting health hazard of the population, HIV, the place of blood sampling, operating mode of procedural offices shall be placed.
12. Each medical examination on detection of HIV shall according to article 16 of the Law of the Republic of Belarus "About the prevention of spread of the diseases constituting health hazard of the population, human immunodeficiency virus" to be followed by dotestovy and posttest consultation with rendering psychological assistance.
13. Medical examination is carried out in case of presentation of the identity document of the citizen, except for performing voluntary medical examination anonymously.
14. When performing obligatory medical examination safety of the citizen and the other persons participating in its carrying out is ensured.
15. By results of medical examination the medical certificate about the state of health according to the procedure, stipulated in Item 7.6 lists of the ministerial procedures performed by state bodies and other organizations for petitions from citizens, No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010 is issued.
