About creative specialists and the creative unions
The parliament adopts this organic law.
(1) the Purpose of this law are creation of legal guarantees for providing the social rights of creative specialists of literature, art and journalism, and also regulation of the legal relationship connected with features of creation and activities of the creative unions - the Union of artists, the Union of architects, the Union of cinematographers, the Union of composers and musicologists, the Union of designers, the Union of journalists, the Union of national masters, the Union of musicians, the Theatrical union, the Writers' Union - and associations of the creative unions, for the benefit of preserving and development of traditions of literature, art and journalism.
(2) Regulation of the legal relationship connected with activities of creative specialists activities of the creative unions and associations of the creative unions is based on provisions of the Constitution of the Republic of Moldova, the Civil code of the Republic of Moldova, the Copyright law and the related rights, the Law on public associations and it is performed by this law, other regulations, and also charters of the creative unions and associations of the creative unions.
For the purposes of this law the following concepts are used:
creative activities in the field of literature, art and journalism (further - creative activities) - activities for creation, execution of literary works and art of all types and genres, for the translation from one language on another of works of art, by whatever method and in what the specified works were expressed to objective form;
benefit for merits – form of the monetary assistance from the government budget which is provided for life for special merits in creative activities to the outstanding persons who reached age of 60 years and being residents of the Republic of Moldova;
the creative specialist of literature, art and journalism (further - the creative specialist) - the physical person creating cultural values, performing works of art and performing creative activities in the respective area within employment contracts or the civil relations or the obnaroduyushchy work without the conclusion of employment or civil contracts;
the professional creative specialist - the physical person who is the owner of the diploma of the licentiate in one or several areas of literature, arts or journalism whose works are appreciated by professionals which creative activities are for it the main source of means of livelihood;
the creative union - the public organization of creative specialists of one or several genres of literature, art or journalism created based on individual membership for protection of the labor, social rights, intellectual property and professional interests of the members, assistance in creation and improvement of conditions of their creative activities.
