About approval of the Regulations on procedure for use of means of the special account for social support of members of families of dead and injured of persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad

1. Approve the enclosed Regulations on procedure for use of means of the special account for social support of members of families of dead and injured of persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad.

2. To assign management of the special account to State commission on coordination of social support of relatives of dead and injured on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad which structure affirms the President of the Kyrgyz Republic.

3. This resolution becomes effective from the date of official publication.

4. To impose control of execution of this resolution on department of social development, department of regional development, transport, construction and communications of Government office of the Kyrgyz Republic.

Regulations on procedure for use of means of the special account for social support of members of families of dead and injured of persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad

1. General provisions

1. This Provision determines procedure and conditions of use of means of the special account for rendering social support of members of families of dead and injured of persons recognized as persons with limited opportunities of health owing to the injuries got as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad.

Manager of means of the special account is State commission on coordination of social support of relatives of dead and injured on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad (further - State commission) which structure affirms the President of the Kyrgyz Republic.

2. Sources of forming of the special account

3. Forming of the special account is made for the account:

1) charitable fees and donations of physical persons and legal entities, including foreign;

2) target grants of the international and other organizations;

3) holding charity events, other actions which are not forbidden by the legislation of the Kyrgyz Republic;

4) other sources which are not forbidden by the legislation of the Kyrgyz Republic.

3. Procedure for use of means of the special account

Means of the special account have special-purpose character, are intended only for social support of members of families of dead and injured of persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad and directed including:

1) on medical examination, treatment, prosthetics and rehabilitation (sanatorium treatment) of injured persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad;

2) on construction of apartment apartment houses for families of dead and injured of persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad;

3) on issue to members of families of the dead and to injured persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad for joint financing of construction of housing (construction of the base, wall, roof);

4) on perpetuation of memory of the dead as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad;

5) on rendering financial support to families of the dead and to injured persons as a result of the events which took place on April 6-7, 2010 in the cities of Talas, Naryn and Bishkek, and also on May 13-14, 2010 in the city of Jalal-Abad.

5. Use of means of the special account in other purposes which are not provided by this Provision is not allowed.

6. Decisions on use of means of the special account are made by State commission.

7. According to the made decisions on allocation of money from the special account, the ministry and department prepare necessary documents for carrying out expenses from the special account and send to the Central Treasury of the Ministry of Finance of the Kyrgyz Republic (further - the Central Treasury).

8. The Central Treasury based on the documents prepared by the ministries and departments sends the declaration letter to bank for carrying out expenses from means of the special account.

9. The Central Treasury records cash flows on the special account and represents to State commission, the Government information on money transfer from the special account.

10. Manager of the means provided in the subitem 3 of item 4 of this provision is the Department of construction engineering construction under the State agency of architecture, construction and housing and communal services under the Government of the Kyrgyz Republic (further - Department).

11. The department acts as the customer, in accordance with the established procedure signs contracts with the project and construction organizations, suppliers of the equipment and construction materials and provides observance by them of terms and quality of construction if it is provided by the relevant decision of State commission.

12. The department provides to State commission the quarterly report on use of means, on issue of money and on the construction course.

4. Procedure for use of means of the special account in case of joint financing of construction of housing

13. The list of persons having the right to funds from the special account for joint financing of construction of housing affirms the decision of State commission.
