1. Approve the Instruction on the organization of work of officials of customs authorities during implementation of preliminary documentary control at check points through frontier of Ukraine which is applied.

2. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk M. O.) and to Department of classification of goods and actions of regulation of foreign trade activities of the State Customs Service of Ukraine (Gutnik A. E.) to provide in accordance with the established procedure:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. Determine that this order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and acting as Chairman of the State Customs Service of Ukraine Derivolkov S. D.

The instruction on the organization of work of officials of customs authorities during implementation of preliminary documentary control at check points through frontier of Ukraine

I. General provisions

1.1. This Instruction determines procedure and the sequence of actions of officials of customs authority during implementation of preliminary documentary control at check points through frontier of Ukraine.

1.2. This Instruction is applied for the purpose of ensuring accomplishment of provisions of the Procedure of the preliminary documentary control at check points through frontier of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 05, 2011 No. 1030, when implementing preliminary documentary goods control which according to the resolution of the Cabinet of Ministers of Ukraine of October 05, 2011 No. 1031 "Some questions of implementation of the state goods control which move through customs border of Ukraine" are subject to sanitarnoepidemiologichesky, veterinary sanitary, phytosanitary, environmental control and control of movement of cultural values in case of their import to customs area of Ukraine (including for the purpose of transit).

II. Implementation by the official of customs authority of preliminary documentary control at the check point through frontier of Ukraine

2.1. After obtaining from carrier or the freight forwarder or the authorized person of shipping (commodity transport) documents on goods which are imported into Ukraine both information on number and document date of the control of movement of goods (further - DKPT) which is drawn up by customs of appointment, the official of customs authority according to provisions of the Procedure for the accomplishment of customs formalities when implementing transit movements approved by the order of the Ministry of Finance of Ukraine of October 09, 2012 No. 1066, registered in the Ministry of Justice of Ukraine on December 19, 2012 for No. 2120/22432, makes the following actions:

makes operational request in the Single automated information system of customs authorities of Ukraine (further - EAIS of State Customs Service of Ukraine) according to number DKPT and checks availability in EAIS of State Customs Service of Ukraine of the electronic copy of this document;

checks compliance of the data provided in the electronic copy of DKPT, to the data specified in the shipping (commodity transport) documents submitted for customs clearance.

2.2. Based on declared in DKPT of commodity code according to UKT foreign trade activities, the description of goods, the movement purpose (import, transit), and according to given carrier or the freight forwarder or the authorized person of shipping (commodity transport) documents the official of customs authority by means of the EAIS corresponding functional module of State Customs Service of Ukraine determines types of the state control and form of their carrying out:

Sanitary and epidemiologic, veterinary and sanitary, phytosanitary, environmental control, control of movement of cultural values in the form of preliminary documentary control are performed by the official of customs authority

or

veterinary and sanitary, phytosanitary, environmental, radiological control is exercised by officials of the relevant monitoring bodies.

2.3. If the goods according to certain commodity code according to UKT foreign trade activities, the description of goods and the purpose of movement (import, transit) belong to:

2.3.1. Are not subject to sanitary and epidemiologic control (including in the form of preliminary documentary control):

pesticides and agrochemicals, disinfectants, the products of medical appointment registered in Ukraine;

samples for carrying out scientific, laboratory research, the state sanitary and epidemiologic examination, testing;

the vehicles in number of one unit arriving to head departments (managements) of work and social protection of the population of the regional, Kiev and Sevastopol city public administrations;

the vehicles in number of one unit received by physical persons;

goods which move through customs border of Ukraine in the modes of temporary import / export;

goods which move through customs border of Ukraine as investments into authorized capital of subjects of managing or based on agreements on joint investing activities;
