About procedure for representation and placement of information in the public information database of the National commission on securities and the stock market on the security market dealers in securities and stock exchanges

According to Item 15 parts two of Article 7 and Item 13 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine", part ten of Article 17 and part three of article 23 of the Law of Ukraine "About securities and the stock market" the National commission on securities and the stock market RESHILA:

1. Determine that the dealer in securities submits to the public information database of the National commission on securities and the stock market about the security market for further placement information on all transactions of rather issued securities made out of stock exchange by it or with its participation within three working days after date execution of the transaction of rather issued securities according to appendix 1 to this decision.

2. Determine that the stock exchange submits to the public information database of the National commission on securities and the stock market about the security market for further placement information on all transactions of rather issued securities made on it until the end of the next working day after date of emergence of the transaction of rather issued securities according to appendices 2, 3 to this decision.

3. The dealer in securities in case of detection of discrepancy of information placed in the public information database of the National commission on securities and the stock market about the security market shall eliminate these discrepancies, repeatedly tax for placement in the public information database of the National commission on securities and the stock market about the security market information, the stipulated in Item 1 this decision, no later than terms, the stipulated in Item 1 this decision.

The stock exchange in case of detection of discrepancy of information placed in the public information database of the National commission on securities and the stock market about the security market shall eliminate these discrepancies, repeatedly tax for placement in the public information database of the National commission on securities and the stock market about the security market information, the stipulated in Item 2 presents of the decision, no later than terms, the stipulated in Item 2 presents of the decision.

Corrected information shall move together with the accompanying reference on correction of information (appendix 4 to this decision) in which the origin of discrepancy (discrepancies) is specified.

The accompanying reference on correction of information in the public information database of the National commission on securities and the stock market on the security market is not displayed.

4. Appendices to this decision are constituted according to the description of Sections and the schemes XML of the files determined by the separate document of normative and technical nature.

5. Determine that the System of reference books and qualifiers of the National commission on securities and the stock market approved by the decision of the National commission on securities and the stock market of May 8, 2012 No. 646, registered in the Ministry of Justice of Ukraine on May 25, 2012 for No. 831/21143, is obligatory for use by dealers in securities and stock exchanges in case of creation and submission of information in the public information database of the National commission on securities and the stock market on the security market.

6. Information moves in the public information database of the National commission on securities and the stock market about the security market in the amount established by this decision and in the terms specified in Items 1 - 3 these decisions.

Information shall contain all corresponding appendices determined by this decision which shall be completed and contain the reliable and complete information.

7. The order of interaction between persons who shall submit information in the stock market and person authorized by the National commission on securities and the stock market on placement of information in the public information database of the National commission on securities and the stock market on the security market is performed according to the regulatory legal act of the National commission on securities and the stock market which regulates relations between persons who shall open information in the stock market, and person, the authorized National commission on securities and the stock market on placement of information in the public information database of the National commission on securities and the stock market on the security market.

8. The state control of observance by dealers in securities and stock exchanges of requirements of this Provision is performed by the National commission on securities and the stock market.

9. And stock exchanges (O. Naumenko) to provide to department of regulation of activities of dealers in securities:

submission of this decision for implementation of examination on compliance of the Convention on human rights protection and fundamental freedoms in the Secretariat of the Government representative for cases of the European Court of Human Rights of the Ministry of Justice of Ukraine;

submission of this decision on state registration in the Ministry of Justice of Ukraine.

10. To provide to management of information technologies, external and internal communications (A. Zaik) publication of this decision according to requirements of the legislation of Ukraine.

11. This decision becomes effective since March 1, 2013, but not earlier than day of its official publication.

12. Control over the implementation of this decision to assign to the member of the commission K. Krivenko.
