About approval of the List and Criteria of determination of groups of the increased risk concerning infection of HIV
According to article 1 of the Law of Ukraine "About counteraction to spread of the diseases caused by the human immunodeficiency virus (HIV) the subitem 4 of item 4 of the Regulations on the Ministry of Health of Ukraine approved by the Presidential decree of Ukraine of April 13, 2011 No. 467, I ORDER to both legal and social protection of people who live with HIV":
1. Approve:
1.1. The list of groups of the increased risk concerning infection of HIV which is applied.
1.2. Criteria of determination of groups of the increased risk concerning infection of HIV which are applied.
2. To the Minister of Health of the Autonomous Republic of Crimea, chiefs of managements (head departments) of health care of the regional, Kiev and Sevastopol city public administrations to consider this order in work.
3. To provide to the director of the department of reforms and development of medical care of MZ of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine.
4. To impose control over the implementation of this order on the deputy minister O. Tolstanov.
5. This order becomes effective from the date of its official publication.

1. Consumers of injecting drugs.
2. Persons who provide sexual services for remuneration.
3. Men who have sexual relations with men.
4. Sexual partners of consumers of injecting drugs.
5. Clients of persons who provide sexual services for remuneration.
6. Sexual partners of men who practice sex with men.

1. Criteria of reference of persons to groups of the increased risk concerning infection of HIV are such forms of behavior:
1.1. The use of narcotic and psychotropic drugs by injection method with use of general syringes, needles for injections and drugs.
1.2. The sexual relations it is more than with one partner without use of remedies, including for remuneration.
1.3. The anal sexual relations without use of remedies, including for remuneration.
2. On condition of application of one of the forms of behavior given in Item 1 of these Criteria, persons who are in difficult vital circumstances can be carried to groups of the increased risk concerning infection of HIV, namely:
persons who contain in organizations of execution of punishments;
homeless;
immigrants;
are exempted from serving of punishments in the form of restriction of will or imprisonment for certain term;
street and neglected children, including children from families which are in difficult vital circumstances, children who do not receive ought parent care.
