About mail service

Chapter 1. General provisions

Article 1. Purpose of mail service

The mail service is integral part of economic and social infrastructure of the Republic of Tajikistan and functions in its territory as interconnected production and economic complex and is intended for satisfaction of needs and requirements of physical persons and legal entities, state governing bodies for services of mail service.

Article 2. Basic concepts

In this Law the following basic concepts are applied:

mail service - the communication type representing single production and technological complex technical and vehicles, providing acceptance, processing, transportation, delivery (delivery) of mailings, and also implementation of postal money transfers;

the single mail territory - the territory on which the single regulations and rules of mail service installing general system of indexation of objects of mail service in the territory of the Republic of Tajikistan, single procedure for registration, acceptance, processing, transportation and delivery (delivery) of all types of mailings act;

the international mail service - exchange of mailings between the organizations of mail service which are under jurisdiction of the Different states;

services of mail service - actions or activities for registration, acceptance, processing, transportation, delivery (delivery) of mailings, and also for implementation of postal money transfers;

universal services of mail service - set of the services of mail service directed to satisfaction of needs of users in services of mail service in the territory of the Republic of Tajikistan and beyond its limits for reasonable prices;

nonconventional services - set of the services provided by operators of mail service to users on contractual basis;

postal money transfer - service of the companies of mail service in registration to acceptance, transportation (transfer), delivery (delivery) of money with use of networks of mail service;

the national operator of mail service - the legal entity who is providing services to mail service, having the license for rendering these services as core activity including universal services of mail service;

operators of mail service - the legal entities and physical persons of any forms of business providing the services of mail service having the license for rendering services of mail service;

means of mail service - buildings, constructions, non-residential premises, the equipment and mail transport, the personalized things, markirovalny machines, mail envelopes and postcards, mail container used for rendering services of mail service;

objects of mail service - separate divisions of the organizations of mail service (post offices, in case of railway post offices, departments of transportation of mail under the railway stations and the airports, nodes of mail service), and also their structural divisions (departments of mail service, Items of mail service and other divisions);

the organizations of mail service - the legal entities of any forms of business of property who are providing services to mail service as core activity and having the license for rendering services of mail service;

the state organizations of mail service - the state organizations (post offices, hub sites) and their structural divisions involved in single production engineering procedure in provision of services of mail service, created based on the property which is in state-owned property;

network of mail service - set of the objects rendering services to mail service, including also mail routes;

written correspondence - letters (simple, custom, with the announced value), postcards (simple, custom), sekogramma (the mailing intended only for blind people), parcels post (simple, custom, with the announced value) and small packets;

the postal address - the place determined by the user of services of the operator of mail service for delivery (delivery) of mailings and postal orders;

the postal index - the schematic digital symbol of the postal address appropriated to object of mail service;

personalized thing - the device (stamp) for drawing on documents and mailings of prints with indication of the name of object of mail service, date of acceptance and delivery of the mailing and other information;

the state signs of mail payment - the stamps applied on mailings and confirming fee of mail service, blocks, the marked envelopes, postcards;

the markirovalny machine - the machine intended for drawing on written correspondence of the state signs of mail payment confirming fee of mail service, date of acceptance to given correspondence and other information;

mail post office box - the special locked box intended for obtaining by addressees mail departure;

subscriber mail cabinet - the special cabinet with the locked cells established in apartment houses, and also on delivery sections, intended for receipt of mailings by addressees;

mailbox - the special locked box intended for collection of non-registered letters and postcards;

mailings - the addressed written correspondence, sending (ordinary, with the announced value), postal money transfers;

the mail carrier - the selected worker of mail service performing delivery of mailings and periodicals in the organizations, organizations and at home;

users of services of mail service - the legal entities and physical persons using services of mail service;

transit of mailings - free promotion of the international mailings through the territory of the Republic of Tajikistan to other state.

Article 3. Legislation of the Republic of Tajikistan on mail service

The legislation of the Republic of Tajikistan on mail service is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also international legal acts recognized by the Republic of Tajikistan.

Article 4. The principles of activities in the field of mail service

Activities in the field of mail service in the Republic of Tajikistan are performed on the basis of the principles:

- respecting the rule of law;

- availability of services of mail service to all physical persons and legal entities;

- provisions of universal services in the territory of the Republic of Tajikistan taking into account observance of the rights of users of services of mail service;

- freedoms of transit of mailings in all territory of the Republic of Tajikistan and ensuring interaction of mail service of the Republic of Tajikistan with the international mail organizations;

- assistance of the workable and fair competition in the market of mail service for the benefit of physical persons and legal entities;

- creating favorable conditions for attraction of domestic and foreign investments in the field of mail service;
