1. Approve the enclosed Rules of carrying out tender at the choice of accreditation body and qualification requirements to accreditation body.

2. This resolution becomes effective from the date of the first official publication.

Rules of carrying out tender at the choice of accreditation body and qualification requirements to accreditation body

1. General provisions

1. These rules of carrying out tender at the choice of accreditation body and qualification requirements to accreditation body (further - Rules) are developed according to the subitem 2) of article 5 of the Law of the Republic of Kazakhstan of July 5, 2008 "About accreditation in the field of assessment of conformity" (further - the Law) and determine procedure for carrying out tender at the choice of accreditation body and qualification requirements to accreditation body.

2. The basic concepts used in these rules:

1) authorized body - the state body performing state regulation in the field of technical regulation and ensuring unity of measurements;

2) the participating company - the legal entity registered in accordance with the established procedure, resident of the Republic of Kazakhstan, who drew up the bid according to the requirements shown by these rules, and submitted it in time no later than established by the information message.

3. The concepts and terms used in these rules are applied according to the legislation of the Republic of Kazakhstan.

4. Competition at the choice of accreditation body is held by authorized body.

5. The authorized body publishes the information message about carrying out tender at the choice of accreditation body on the Internet resource, and also in republican periodic printing editions not later than twenty calendar days before carrying out tender.

The message on carrying out tender shall contain the following data:

1) name and location of authorized body;

2) place and methods of receipt of the detailed information;

3) the place and final term of submission of competitive offers, and also the place, date and time of opening of envelopes with competitive offers.

6. Authorized body:

1) accepts from the participating companies envelopes with competitive offers;

2) keeps magazines of registration of the arrived competitive offers and authorized representatives of the participating companies which showed willingness to participate in the procedure of opening of envelopes. In magazines time and date of representation by the participating company of envelope with the competitive offer, surname, name, middle name of the authorized representative of the participating company (the person which provided envelope with competitive the offer and participating in tender) are reflected.

7. The competitive offer represented by the participating company which showed willingness to participate in tender shall contain:

1) the bid according to appendix to these rules;

2) the list of the documents confirming compliance to the qualification requirements imposed to the participating company:

copy of the certificate * or certificates of state registration (re-registration) and charter of the legal entity.

Note: * the certificate on the state (accounting) registration (re-registration) of the legal entity (branch, representation) issued before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning state registration of legal entities and accounting registration of branches and representations" is valid before the termination of activities of the legal entity;

the documents confirming membership in the international organizations for accreditation;

the original of the certificate of bank (banks) of lack of arrears in three months preceding date of opening of envelopes to bank (banks) (if the participating company is client of several banks of the second level or branches, and also foreign bank, this reference is submitted from each of such banks) signed by the first head or person replacing it with seal of bank (banks);

the original of the balance sheet for the last financial year signed by the first head or person replacing it, and also the chief accountant (accountant) certified by seal;

the original or notarially attested copy of the audit report for the last financial year of legal entities for whom legal acts of the Republic of Kazakhstan establish obligatory carrying out audit;

information on availability of qualified personnel (accreditation experts-auditors) with copies of supporting documents;

information on availability at personnel of work experience on work on accreditation.

8. The competitive offer is presented by the participating company in the stitched form with the numbered pages and certified by seal.

9. In the competitive offer introduction of inserts between lines, podtirok or additions is not allowed.

10. The envelope with the competitive offer is sent in authorized body to the address specified in the information message about carrying out tender and shall contain the words "Tender at the Choice of Accreditation Body" and "Not Open to __________________________________________". (date and time of opening of envelopes)

11. The participating company has the right to withdraw the competitive offer. The notification on response goes the participating company in writing, but no later than the final term specified in the official information message.

12. The authorized body opens envelopes with bids in time, time and the place which are specified in the tender documentation.

In case of opening of envelope with bid the authorized body announces information on the list of the documents and materials containing in the bid.

The participating company which submitted the bid and (or) her authorized representative has the right to be present on condition of submission of the power of attorney when opening envelopes with bids with the right of maintaining audio recording or video filming.
