Rules of provision of federal property to socially oriented non-profit organizations in ownership and (or) in use on long-term basis.

2. The realization of this resolution is enabled by the Ministry of Economic Development of the Russian Federation and Federal Agency for State Property Management within the established number of employees of their central offices and territorial authorities, and also budgetary appropriations provided to the specified Ministry and the Agency in the federal budget on management and management in the sphere of the established functions.

These rules establish procedure for forming, maintaining and obligatory publication of the list of federal property, free from the third party rights (except for property rights of the non-profit organizations which are not the public and local government offices) which can be provided to socially oriented non-profit organizations in ownership and (or) in use on long-term basis (further - the list).

3. Forming of the list is performed by Federal Agency for State Property Management (further - authorized body).

3(1). The authorized body determines as a part of property of the state treasury of the Russian Federation the non-residential premises which are in federal property and free from the third party rights (except for property rights of the non-profit organizations which are not the public and local government offices) (further - non-residential premises) which can be provided to socially oriented non-profit organizations in ownership and (or) in use on long-term basis, and makes decisions on inclusion of non-residential premises in the list.

In the list data on the federal property conforming to the following requirements are entered:

the non-residential premise is not included in the list of federal property, free from the third party rights (it is except for right economic conducting, the right of operational management, and also property rights of subjects of small and medium business), provided by part 4 of article 18 of the Federal law "About Development of Small and Medium Business in the Russian Federation", for the purpose of provision of federal property in ownership and (or) in use on long-term basis to the subjects of small and medium business and the organizations forming infrastructure of support of subjects of small and medium business;

the non-residential premise is not included in the forecast plan (program) of privatization of federal property for the planning period approved by the Government of the Russian Federation according to the subitem 3 of Item 1 of article 6 of the Federal law "About Privatization of the State-owned and Municipal Property" or in the list of federal property which privatization is performed without inclusion in the forecast plan (program) of privatization of federal property for the planning period approved by the order of the Ministry of Finance of the Russian Federation;

the non-residential premise is not property of religious appointment;

the decision of the President of the Russian Federation or the Government of the Russian Federation on provision to his other persons is not made on the non-residential premise;

the non-residential premise not to acknowledged emergency and subject demolitions or reconstruction;

total area of the non-residential premise constitutes at least 20 sq.m.

5. The decision of authorized body on inclusion of the non-residential premise in the list or on exception of the non-residential premise of the list contains the following data on the non-residential premise:
