1. Approve the enclosed Rules of rendering services of TV and radio broadcasting.
2. To provide to department of strategic planning and international cooperation of the Ministry of Culture and information of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) in accordance with the established procedure official publication of this order;
3) placement of this order on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan.
3. To impose control of execution of this order on the vice-Minister of Culture and Information of the Republic of Kazakhstan Kyrykbayev A. O.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of rendering services of TV and radio broadcasting (further - Rules) are developed according to the subitem 11) of Item 1 of article 7 of the Law of the Republic of Kazakhstan "About TV and radio broadcasting" (further - the Law) and determine procedure for rendering services of TV and radio broadcasting in the territory of the Republic of Kazakhstan.
2. These rules extend on:
1) the operators of TV and radio broadcasting rendering services of TV and radio broadcasting and technologically related services;
2) the physical persons and legal entities which signed the contract for receipt of services of TV and radio broadcasting with the operator of TV and radio broadcasting (further - the subscriber);
3) domestic TV, radio companies, and also on branches (representations) foreign TV, radio channels (broadcasting company);
4) distributors of individual satellite and radio intakes (further - the distributor).
3. In these rules the following concepts are used:
1) subscriber line - the communication line which is part of local network of telecommunications and connecting the subscriber device to means of telecommunications of this network;
2) accession to the public agreement - method of the conclusion of the contract between the operator of TV and radio broadcasting and the subscriber in case of whom the joining subscriber accepts conditions of the offered public agreement according to the procedure the public agreement provided by it offered by the Operator;
3) the distributor of individual satellite and radio intakes - the physical person or legal entity distributing maps of conditional access to services of operators of TV and radio broadcasting, the equipment intended for individual acceptance TV, radio signal of the operators of TV and radio broadcasting having the license in the field of TV and radio broadcasting and having own satellite systems of broadcasting to the territories of the Republic of Kazakhstan;
4) the customer premise equipment - the technical means (including, receiving satellite set, the television receiver, the radio receiver) intended for acceptance, processing and reproduction of signals TV, radio channels;
5) signal TV, radio channel - electric signal TV, radio channel which technological parameters are determined according to technical regulations and standards;
6) network of the operator of TV and radio broadcasting - the set of the technical means and communication links providing relaying TV, radio channels in the territory determined by parameters of these means used by the operator of TV and radio broadcasting;
7) TV and radio broadcasting - forming and (or) distribution TV, radio channels with use of technical means of telecommunications and in networks of telecommunications for public acceptance by the consumer in the opened or coded type;
8) the card of conditional access - the device containing the identifier of individual satellite and radio intakes, providing access for the subscriber to services of the operator of TV and radio broadcasting;
9) broadcast channel - the physical medium created by radio-electronic technical means on which delivery of signal TV, radio channels from source to the subscriber is performed;
10) the operator of TV and radio broadcasting - the physical person or legal entity which obtained the license for occupation activities for distribution TV, radio channels;
11) the Internet - the world system of the joint networks of telecommunications and computing resources for transfer of electronic information resources.
4. The operator of TV and radio broadcasting when forming packets TV, radio channels places obligatory TV, radio channels with respect for the sequence of sequence number, according to the list obligatory TV, radio channels, to No. 171 approved by the order of the Minister of information and social development of the Republic of Kazakhstan of June 17, 2019 (it is registered in the Register of state registration regulatory legal acts at No. 18861), in priority procedure by assignment in digital broadcasting and broadcasting in networks of telecommunications of consecutive numbers, starting with the first and more, and in analog broadcasting by placement at the beginning of grid of separation of frequencies of channels.
5. Relations of operators of TV and radio broadcasting with subscribers and TV, radio companies, arising when rendering services of TV and radio broadcasting, are performed in the state and Russian languages.
6. Services of TV and radio broadcasting are:
1) services of on-air TV and radio broadcasting;
2) services of satellite TV and radio broadcasting;
3) services of cable TV and radio broadcasting;
4) services of TV and radio broadcasting in networks of telecommunications.
7. Services of TV and radio broadcasting are rendered in compliance with the rates established by operators of TV and radio broadcasting.
The operator of TV and radio broadcasting informs subscribers and TV, radio companies on change of rates on the Internet resource and (or) service centers of subscribers not later than ten calendar days before introduction of new rates.
