1. Approve the enclosed Rules of carrying out tender on forming of the list obligatory TV, radio channels.

2. This resolution becomes effective after thirty calendar days after the first official publication.

Rules of carrying out tender on forming of the list obligatory TV, radio channels

1. General provisions

1. These rules of carrying out tender on forming of the list obligatory TV, radio channels (further - Rules) are developed according to the subitem 6) of article 6 of the Law of the Republic of Kazakhstan of January 18, 2012 "About TV and radio broadcasting" and determine procedure for carrying out tender by forming of the list obligatory TV, the radio channels extended by means of multichannel broadcasting in all territory of the Republic of Kazakhstan (further - tender).

2. Consideration of requests TV, radio companies (further - applicants) on participation in tender and development of offers on forming of the list obligatory TV, radio channels is performed by the Commission on questions of development of TV and radio broadcasting (further - the Commission) created by the Government of the Republic of Kazakhstan.

3. The Committee of information and archives of the Ministry of Culture and information of the Republic of Kazakhstan (further - the organizer) which is working body of the Commission acts as the organizer of carrying out tender.

4. According to recommendations of the Commission the Government of the Republic of Kazakhstan approves the list obligatory TV, radio channels (further - the list).

5. Forming of the list is performed once in three years.

2. Procedure for carrying out tender

6. The decision on carrying out tender is made by the organizer. The information message about carrying out tender is published in mass media and on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan by http://mki.gov.kz/ at least in forty calendar days prior to day of its carrying out. The information message about tender shall contain:

1) start and end date of order taking;

2) date, the place and time of opening of envelopes with requests of applicants.

7. The beginning and the end of acceptance of the request of the applicant (further - the request) in form, according to appendix 1 to these rules, are performed in time, specified in the information message. Together with the request applicants represent to the organizer competitive offers (further - documents) according to the requirements provided in appendix 2 to these rules.

8. The request with the enclosed documents is presented to the organizer in the numbered and strung together form, the last page is certified by the sign and seal of the applicant (for physical person if that is available) of sealed envelope.

9. The requests which arrived after the expiration of the order taking specified in the information message about carrying out tender are not accepted.

10. The commission opens envelopes with documents in the terms and the place specified in the information message about carrying out tender in the presence of applicants or their authorized representatives.

11. The applicant is not allowed to participation in tender, in case of mismatch of the request to the form provided by these rules, to requirements, stipulated in Item 8 these rules, and also representation of incomplete document package.

12. The organizer constitutes the protocol of opening of envelopes during two workers from the date of their opening.

The protocol of opening of envelopes is signed by the chairman, the being present members of the commission and the secretary of the Commission.

Results of opening of envelopes are subject to publication on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan of http://mki.gov.kz/ within two working days from the moment of signing of the protocol.

13. The commission considers requests no more than five working days from the date of their opening in time.

14. Selection criteria in case of determination of winners are the social importance of programs, availability in broadcasting schedule cultural, scientific and educational, cognitive and educational youth, children's TV, radio programs, publicizing of state policy in the field of social and economic development of the republic.

Also selection criteria are the thematic orientation and genre ratio, amount own TV, radio programs, purchased TV, radio programs and relaying, broadcasting amount in state language, average daily time of broadcasting, personnel potential.

15. Applicants are recognized winners of tender if the simple majority of the present members of the commission voted for them. In case of equality of votes, the voice of the commission chairman is decisive.

16. Following the results of tender of the recommendation of the Commission are drawn up by the protocol signed by the chairman and members of the commission.

17. Results of tender are placed on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan of http://mki.gov.kz/ within two working days from the moment of signing of the protocol.

18. The organizer the copy of the protocol of the Commission and the draft of the order of the Government of the Republic of Kazakhstan about approval of the list within one month after summing up tender go to the Government of the Republic of Kazakhstan.
