1. Approve the enclosed Rules of accreditation of energy saving and increase in energy efficiency.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of accreditation of energy saving and increase in energy efficiency

1. General provisions

1. These rules of accreditation in the field of energy saving and increase in energy efficiency (further - Rules) are developed according to the subitem 4) of article 4 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increase in energy efficiency" and determine procedure for carrying out accreditation of legal entities, issues by authorized body of the certificate on accreditation.

2. In Rules the following basic concepts are used:

1) accreditation - the procedure of official recognition of competence of legal entities by authorized body to perform energy audit and (or) examination of energy saving and increase in energy efficiency;

2) the certificate on accreditation - the official document issued by authorized body in the field of energy saving and increase in energy efficiency, certifying competence of legal entities to perform energy audit and (or) examination of energy saving and increase in energy efficiency;

3) authorized body in the field of energy saving and increase in energy efficiency (further - authorized body) - the central executive body performing management in the field of energy saving and increase in energy efficiency;

4) energy audit - collection, processing and data analysis about use of energy resources for the purpose of assessment of opportunity and energy saving potential and preparation of the conclusion;

5) examination of energy saving and increase in energy efficiency - the expertize which is carried out for the purpose of assessment of energy efficiency of the architectural and construction and technical solutions connected with use of energy resources and cost optimization of consumers on power supply in case of construction of buildings, structures, constructions, and also carrying out their reconstruction, major repair;

6) the expert organization the power accountant - the legal entity accredited by authorized body to perform industrial energy audit and (or) buildings, structures, constructions;

7) the expert organization for examination of energy saving and increase in energy efficiency - the legal entity accredited by authorized body to perform examination of energy saving and increase in energy efficiency of preproject and (or) project (project and estimate) documentation of buildings, structures, constructions.

3. Accreditation is performed concerning the legal entity for receipt of competence to render services in carrying out energy audit or examination of energy saving and increase in energy efficiency.

4. Accreditation of the legal entity is carried out by authorized body.

2. Procedure for carrying out accreditation

5. For receipt of accreditation on carrying out energy audit or examination of energy saving and increase in energy efficiency the legal entity submits the following documents to authorized body:

1) the statement in form according to appendix 1 to these rules;

2) copies of the charter and the certificate * or certificates of state registration (re-registration) as the legal entity (notarially attested in case of non-presentation of originals for reconciliation).

Note: * The certificate on the state (accounting) registration (re-registration) of the legal entity (branch, representation) issued before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning state registration of legal entities and accounting registration of branches and representations" is valid before the termination of activities of the legal entity;

3) the documents confirming availability of the corresponding material logistics namely:

for the expert organizations of the power accountants accredited on provision of services on carrying out industrial energy audit, and also buildings, structures and constructions, information and measuring complexes and technical means on the property right according to appendix 2 to these rules, their certification and the state checking;

for the expert organizations of the power accountants accredited on provision of services on carrying out energy audit of buildings of structures and constructions - information and measuring complexes and technical means on the property right, according to appendix 3 to these rules, their certification and the state checking;

4) the documents confirming availability of the qualified personnel having the higher technical education and having general technical length of service at least 3 years namely:

for the expert organizations of power accountants of electropower engineering specialists with electrical safety group of the IV and above, and also heatpower engineering specialists - with electrical safety group of the IV and above;

for the expert organizations for examination of energy saving and increase in energy efficiency - experts in examination of town planning, preproject and proyektnosmetny documentation with appendix of the corresponding certificate issued by authorized body for architecture, town planning and construction;

5) certificates on passing of rates in training centers on retraining and advanced training of the personnel performing energy audit and (or) examination of energy saving and increase in energy efficiency and also creation, implementation and the organization of system of power management at least two employees in the directions energy audit and (or) examination of energy saving and increase in energy efficiency.

Legal entities, akcreditituyemy till July 1, 2013, for passing of the procedure of accreditation submit to authorized body the documents specified in subitems 1) - 4) Item 5 of these rules.
