Rules of subsidizing on compensation of rate of remuneration on the credits (leasing) for support of agricultural industry

1. General provisions

1. These rules of subsidizing on compensation of rate of remuneration on the credits (leasing) for support of agricultural industry (further - Rules) are developed according to article 11 of the Law of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development of agro-industrial complex and the rural territories", article 14 of the Law of the Republic of Kazakhstan of November 23, 2012 "About the republican budget for 2013-2015" and determine procedure for provision of subsidies for compensation of part of costs of borrowers for payment of loan interest rates (leasing) for the account and within the means provided in the republican budget for 2013-2015 within the budget subprogramme 100 "Compensation of rate of remuneration on the credits (leasing) for support of agricultural industry of" the program 213 "Development of processing industries" (further - the program).

2. In these rules the following concepts and determinations are used:

1) administrator of the budget program - Ministry of Agriculture of the Republic of Kazakhstan;

2) financial institutions - the banks of the second level, credit institutions having the corresponding license for the right of implementation of banking activity, leasing companies;

3) the borrower - the physical, legal entity irrespective of pattern of ownership, including the peasant farm which is engaged in conversion of agricultural products, production of food products, the legal entity having on the property right the service and procurement center, and the rural consumer cooperative rendering services in procurement, storage, transportation and realization of agricultural products;

4) the credit (leasing) - the amount of money (leasing subject) provided by financial institution to the borrower based on the credit agreement;

5) the credit agreement - the loan agreement (financial leasing) signed between financial institution and the borrower;

6) remuneration rate - the amount of remuneration established by the credit agreement between financial institution and the borrower for use of the credit (leasing).

2. Subindustries of production (conversion) of agricultural products and cost types on which subsidies are provided

3. At the expense of means of the republican budget of subsidy are provided for the purpose of providing financial support in the following priority directions:

1) group "A" - the borrowers who are engaged:

conversion of fruits, berries, vegetables and production of fruit and vegetable canned food;

production of fowl, eggs and egg powder;

conversion of fish and fish products;

conversion of milk and production of dairy products;

conversion of oil-bearing crops and production of fat-and-oil products;

conversion of meat and production of meat products;

production of white sugar;

conversion of corn;

2) group "B" - the borrowers who are engaged:

conversion of rawhide and wool;

production of grain;

production of the combined forages;

3) group "B" - the legal entities having on the property right the service and procurement centers, and the rural consumer cooperatives which are engaged in procurement, storage, transportation and realization of agricultural products:

fruits, vegetables, fruit;

milk;

meat;
