1. Approve the enclosed Regulations on procedure for determination of the prices (rates) for goods (works, services) the business entities regulated by the state.

2. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of July 17, 2003 No. 445 "About approval of the Regulations on procedure for determination of the prices (rates) for goods (works, services) the business entities regulated by the state" of October 21, 2008 No. 590.

3. To impose control of execution of this resolution on the state antimonopoly authority of the Kyrgyz Republic.

4. This resolution becomes effective after 15 days from the date of official publication.

Regulations on procedure for determination of the prices (rates) for goods (works, services) the business entities regulated by the state

1. General provisions

1. This Regulations on procedure for determination of the prices (rates) for goods (works, services) the business entities regulated by the state (further - the Provision) extend to subjects of natural monopolies (in spheres, according to article 2-1 of the Law of the Kyrgyz Republic "About natural monopolies in the Kyrgyz Republic"), and also other business entities, price regulation (rates) for goods (works, services) which is performed according to the decision of the Cabinet of Ministers of the Kyrgyz Republic (further - subjects).

The provision is basic when forming costs by subjects of natural monopolies, including in case of application of methods of regulation, the stipulated in Article 4 Laws of the Kyrgyz Republic "About natural monopolies in the Kyrgyz Republic". Establishment of method of regulation and specifics of pricing (rates) of subjects is considered in the industry technique developed in coordination with authorized body and approved in accordance with the established procedure.

2. The provision is developed for the purpose of forming of single approaches for subjects in case of determination of structure of the costs included in products cost in case of establishment (approval) of the prices (rates) or their limit, size of the trade allowance.

3. The prices (rates) are created proceeding from economically reasonable costs (actual and/or planned) and the size of the profit determined individually for each subject taking into account industry specifics, in coordination with authorized body according to the legislation of the Kyrgyz Republic, and the taxes provided by the tax legislation.

This Provision is not applied in the following cases:

- in case of determination of the prices of socially important goods regulated according to the Law of the Kyrgyz Republic "About pricing";

- in case of price fixation on the material values issued from the state material reserve.

3-1. When implementing price regulation (rates) for goods (works, services) the authorized body has the right to apply subjects of natural monopolies to calculation of necessary gross revenue of the subject of natural monopoly, including the following methods of price regulation (rates) and (or) their combinations according to the legislation on natural monopolies:

1) method of economically reasonable costs;

2) income method of the invested capital;

3) method of comparative analysis.
