Conditions and restrictions on use of goods and vehicles with incomplete customs clearance and to the order them

1. General provision

"Conditions and restrictions on use of goods and vehicles with incomplete customs clearance and to the order them" are prepared based on Article 105.2 of the Customs code of the Azerbaijan Republic and determine conditions and restrictions on use of goods and vehicles with incomplete customs clearance and to the order them.

2. Conditions on use of goods and vehicles with incomplete customs clearance and to the order them

2.1. Use of the goods and vehicles provided to customs authority without completion of their customs clearance and the order are performed by them on permission of customs authority with full compliance with the conditions provided below:

2.1.1. in case of possibility of implementation of customs control over goods;

2.1.2. in case of customs payment on goods and vehicles, or, in cases of education or possible formation of customs debt on them presented providing on its repayment;

2.1.3. in the presence of the relevant allowing document or special permission (license) for goods and vehicles in cases when it is required based on the legislation of the Azerbaijan Republic.

2.2. For use of goods with incomplete customs clearance person, authorized concerning goods, shall file petition in customs authority with indication of the reasons of incompleteness of registration and purpose of use.

2.3. Customs authorities consider the application submitted by it no more than 2 (two) working days in time.

2.4. In each case of use of goods and vehicles with incomplete customs clearance and orders them customs authorities accept the separate resolution.

3. Restrictions to use of goods and vehicles with incomplete customs clearance and to the order them

3.1. Use of goods and vehicles with incomplete customs clearance and the order them are allowed only according to requirements of customs procedure on which they were placed.

3.2. Right to use and orders goods and vehicles with incomplete customs clearance cannot be provided to other person in addition to person having right to use these goods and vehicles.

4. Completion of customs clearance

4.1. For completion of customs clearance the customs applicant shall provide to customs authorities the customs declaration in time, established by the Customs code of the Azerbaijan Republic.

4.2. Use of goods and vehicles with complete customs clearance and the order them are performed according to the chosen customs procedure.
