About Regulations on Council of Ministers of the Union State

According to item 4 of article 44 of the Agreement on creation of the Union State the Supreme State Council of the Union State decides:

1. Approve Regulations on Council of Ministers of the Union State it (is applied).

2. This resolution becomes effective from the date of its signing.

Regulations on Council of Ministers of the Union State

I. General provisions

1. The Council of Ministers of the Union State (further - Council of Ministers) is the collegiate executive body of the Union State performing according to the Agreement on creation of the Union State (further - the Agreement) management of system of the industry and functional bodies of the Union State subordinated to it.

2. The Council of Ministers has power to initiate legislation in the Union State.

II. Basic principles and legal basis of activities of Council of Ministers

3. The Council of Ministers in the activities is guided by the principles of sovereign equality of the State Parties, voluntariness, fair accomplishment of cross liabilities by them.

4. The structure of Council of Ministers, its competence, procedure for activities and the relation of Council of Ministers with other bodies of the Union State are determined according to the Agreement and this Provision.

5. The Council of Ministers acts on the basis of the also in agreement performance, the Action programs of the Russian Federation and the Republic of Belarus on realization of provisions of the Agreement on creation of the Union State (further - the Program), constitutions of the State Parties, acts of the Union State and this provision.

III. Accountability of Council of Ministers

6. The Council of Ministers in the activities is accountable to the Supreme State Council.

7. The Council of Ministers submits annual statements about implementation of the made decisions to the Supreme State Council, and also reports and information on the activities to Parliament of the Union State (further - Parliament).

IV. Competence of Council of Ministers

8. Council of Ministers:

- develops the main directions of general policy on issues of development of the Union State and brings them in the Supreme State Council for consideration;

- controls accomplishment of provisions of this agreement, Programs, acts of the Union State and if necessary brings motivated representations to the State Parties in case of default on obligations, following from them;

- provides creation and development of common economic space, carrying out single financial, tax, credit, monetary, monetarist, price and trade policy;

- coordinates process of standardization of legislations of the State Parties;

- promotes carrying out coordinated policy of the State Parties in the international cases, in the field of defense, safety, law enforcement, the rights and freedoms of citizens, ensuring public order and fight against crime, and also in the field of culture, science, education, health care, social security and environmental protection;

- makes offers on forming of industry and functional bodies of the Union State in the Supreme State Council and performs management of their activities;

- introduces drafts of the allied laws and Bases of the legislation to Parliament;

- previously considers offered by the State Parties, Parliament and Court of the Union State of the amendment to the Agreement;

- agrees to entering into Parliament of the bills providing the expenses covered by budget funds of the Union State;

- develops and introduces the budget statement of the Union State to Parliament, provides and determines procedure for budget implementation, submits to Parliament annual and semi-annual reports on budget implementation;

- approves procedure for development and program implementation, projects and actions of the Union State;

- can have the representative in Parliament;

- makes in accordance with the established procedure in Parliament offers on additional sources of filling of the budget of the Union State;

- represents to Parliament of the candidate for appointment as members of Audit Chamber;

- approves regulations of Audit Chamber, considers its reports and reports;

- exercises property management of the Union State;

- appoints the members of Standing Committee pushed by the governments of the State Parties;

- approves the number of employees of Standing Committee and makes the offer on the matter in the Supreme State Council;

- approves structure of Standing Committee and expense budget on its content within the approved budget of the Union State;

- exercises control of activities of industry and functional bodies of the Union State, and also of execution of the State Parties of regulatory legal acts of the Union State by the governments;

- repeals acts of industry and functional bodies of the Union State in case of their contradiction to regulatory legal acts of the Union State;

- regulates questions of financial and economic activities of bodies of the Union State according to regulatory legal acts of the Union State, and also the legislation of the State Parties;

- approves regulations of Council of Ministers;

- performs other powers assigned to it by the Agreement and decisions of the Supreme State Council.

The Council of Ministers within the competence issues resolutions, directives and resolutions.

The decision of Council of Ministers can be suspended or cancelled by the Supreme State Council.

V. Structure of Council of Ministers

9. The Council of Ministers includes the Chairman of the board of Ministers, heads of governments, the State secretary (as the vice-chairman of Council of Ministers), Ministers of Foreign Affairs, economy and finance of the State Parties, heads of the main industry and functional governing bodies of the Union State.

VI. Procedure for forming of Council of Ministers

10. The chairman of the board of Ministers is appointed to position and dismissed by the Supreme State Council. The head of the government of one of the State Parties on rotational basis can be him.

11. The state secretary, heads of industry and functional governing bodies of the Union State are appointed and dismissed by the Supreme State Council on representation of the Chairman of the board of Ministers.

Cabinet ministers - heads of governments, Ministers of Foreign Affairs, economy and finance of the State Parties are part of Council of Ministers on position.

VII. Chairman of the board of Ministers

12. Chairman of the board of Ministers:

- performs management of activities of Council of Ministers and will organize its work;
