The Ministry of Justice of the Republic of Belarus and the Ministry of Justice of the Azerbaijan Republic which are hereinafter referred to as "Party"
aiming at establishing bonds in the field of judicial and expert activities and nauchnoissledovatelsky works,
for the purpose of increase in fight against crime on the basis of active use of modern methods and means of judicial examination and criminalistics, considering that strengthening of the available relations of friendship and mutually beneficial cooperation is equitable to national interests of both countries,
and also for the purpose of further strengthening of the relations by development of cooperation in the field of the right and law-enforcement activities
agreed as follows:
The cooperation of the Parties based on this agreement in the field of judicial examination is performed for the purpose of joint scientific operation on the main problems in this industry, enhancement existing and creations of new methods and techniques of judicial examination, experience exchange concerning expert practice.
The cooperation of the Parties based on this agreement is performed directly, and also through the Center of judicial examinations and criminalistics of the Ministry of Justice of the Republic of Belarus and the Center of judicial examination of the Ministry of Justice of the Azerbaijan Republic.
The parties will develop cooperation on the following activities according to the national legal system of the states and within the powers:
1. Experience exchange and information in the field of judicial examination and criminalistics:
about research and developmental developments;
about new collections, the educational, methodical and reference media;
about the planned scientific and methodical and practical actions (scientific conferences, seminars, exhibitions in the field of criminalistics and judicial examination);
about enhancement of the hardware and software and methods of the expert researches used in case of production of judicial examinations.
2. Coordination of scientific work on problems of judicial examination in shape:
joint development of methods and techniques of judicial examination;
accomplishment of scientific developments according to requests of one of the Parties;
implementation of author's maintenance and implementation of developments in expert practice.
3. Preparation and advanced training of personnel on basis:
carrying out joint schools, seminars, rates on development of new methods and techniques of judicial examination;
mutual training of specialists.
4. Reviewing of scientific developments and expert opinions in coordination with heads of expert organizations of both Parties.
5. Approbation of techniques of the expert researches and technical means developed by the Parties.
6. Rendering other scientific and methodical, advisory and technical assistance each other in questions of scientific and expert activities.
The parties will perform the measures which are not provided by this agreement, but answering to the purposes of development of cooperation in the field of judicial examination between the Republic of Belarus and the Azerbaijan Republic according to the national legal system of the states of the Parties and within powers of the Parties.
The obligations connected with action of this agreement, the Parties shall carry out on a grant basis if the Parties do not agree about other.
The parties will annually determine cooperation amount, financial and organizational matters of implementation of actions.
When financing of the events held within this agreement, the Parties will adhere to the principle according to which expenses on their organization and stay of delegations of the Parties in the territory of the host state are incurred by the host party, and the international transportation expenses are incurred there and back by the sending party.
In case of execution of this agreement of the Party will use the languages acceptable for both Parties.
According to the mutual arrangement of the Parties changes and additions which are drawn up by the separate protocols which are its integral part and becoming effective according to the procedure, established in Article 10 of this agreement can be made to this agreement.
Disputes and disagreements which can arise between the Parties on the questions concerning this agreement coverage will be resolved by bilateral negotiations and consultations.
This agreement is signed sine die and becomes effective from the date of receipt of the last written notice of the Parties of accomplishment of the interstate procedures necessary for its entry into force, through diplomatic channels.
Each of the Parties can terminate this agreement, having directed the written notice through diplomatic channels. The Agreement is terminated through six (6) months after receipt of such notification by other Party.
This agreement is signed in the city of Minsk on August 28, 2012 in two authentic copies, everyone in the Belarusian, Azerbaijani and Russian languages, and all texts are equally authentic. In the presence of disagreements in interpretation of this agreement the text in Russian will be used.
