About measures for strengthening of interaction of the Ministries of Internal Affairs of the State Parties of the Union of Belarus and Russia

Boards of the Ministry of Internal Affairs of Belarus and the Ministry of Internal Affairs of Russia note that signing and entry into force of the Agreement on the Union of Belarus and Russia and the Charter of the Union of Belarus and Russia opened the new page in the Russian-Belarusian relations. The legal base for intensive development of comprehensive and mutually advantageous bonds of two friendly states including in the field of fight against crime which in the states of the Union becomes one of the most acute social issues is created.

Special peril organized forms of criminal activities, drug trafficking, smuggling, arms trafficking and explosives acquired, plunders of motor transport, historical and cultural values which are more and more internationalized illegal migration, illegal export of raw materials, energy carriers, non-ferrous and rare-earth metals. Scale of crimes increases in credit and financial and external economic spheres, corruptibility in power structures and governing bodies.

Boards consider that in these conditions combination of efforts and constructive cooperation, strengthening of coordination in activities of the Ministries of Internal Affairs of Belarus and Russia are indispensable condition of increase in their effectiveness in solutions of tasks of strengthening of fight against crime and the real guarantor of reliable providing legitimate rights and interests of citizens of the Union.

In the organization of cooperation of two ministries certain positive experience is accumulated. Number of international treaties within which implementation joint operations on suppression of activities of criminal groups, channels of intake of drugs and weapon are performed is concluded. Exchange of regulations, special literature is performed.

However the level of the organization of practical interaction does not meet the qualifying standards yet. The available reserves are fully not used.

Also the regulatory framework of collateral actions requires essential strengthening contractual. Provisions of the existing contractual documents often remain unrealized. There are financial straits with implementation of the adopted programs.

Interaction is not fully provided with operational and help, search, criminalistic and other information.

Sluggishness in case of execution of orders about rendering legal assistance on criminal cases is shown that leads to tightening of terms of pretrial investigation, and it is frequent also to loss of proofs.

Questions of the organization and carrying out systematic working meetings of representatives of the Ministry of Internal Affairs of Belarus and the Ministry of Internal Affairs of Russia concerning fight against the international crime, and also border and transport law-enforcement bodies, joint scientific research and developmental works, cooperation in the field of the organization of execution of punishments and training need settlement.

Boards consider that the organization of interaction of law-enforcement bodies of two countries in the solution of the questions which are of mutual interest shall be performed quickly, without excessive costly bureaucratic procedures and in strict accordance with the legislation of the State Parties of the Union, their international obligations.

Boards solved:

1. Approve draft agreements on cooperation between the Ministry of Internal Affairs of the Russian Federation and the Ministry of Internal Affairs of the Republic of Belarus (appendix 1), Agreements between the Ministry of Internal Affairs of the Russian Federation and the Ministry of Internal Affairs of the Republic of Belarus on cooperation of law-enforcement bodies of border regions (appendix 2) and the Protocol on interaction between the Ministry of Internal Affairs of the Russian Federation and the Ministry of Internal Affairs of the Republic of Belarus for 1998 (appendix 3).

To build the organization of interaction in strict accordance with the principles of legality and the strict obligation fulfillment following from international treaties which participants are Belarus and Russia.

2. Accept the joint appeal of boards of the Ministry of Internal Affairs of the Republic of Belarus and the Ministry of Internal Affairs of the Russian Federation to staff of law-enforcement bodies and internal troops of the State Parties of the Union of Belarus and Russia (appendix 4).

3. Enter with the petition into Executive Committee of the Union of Belarus and Russia for formation of the Joint board of the Ministries of Internal Affairs of the Republic of Belarus and the Russian Federation as permanent body of the Union on coordination and interaction of the Ministry of Internal Affairs of Belarus and the Ministry of Internal Affairs of Russia.
