RESOLUTION OF COUNCIL OF MINISTERS OF THE UNION STATE

About Regulations of Council of Ministers of the Union State

The Council of Ministers of the Union State decides:

1. Approve Regulations of Council of Ministers of the Union State it (is applied).

2. The regulations of Council of Ministers of the Union State come into effect from the date of approval by the Supreme State Council of the Union State of the Regulations on Council of Ministers of the Union State.

Regulations of Council of Ministers of the Union State

I. General provisions

1. These Regulations according to the Agreement on creation of the Union State (further - the Agreement), the laws and other regulatory legal acts of the Union State, Regulations on Council of Ministers of the Union State (further - the Provision) establish the basic rules of the organization of activities of Council of Ministers of the Union State (further - Council of Ministers) on realization of its powers.

2. Performs management of activities of Council of Ministers and the Chairman of the board of Ministers will organize its work.

Powers and functions of the Chairman of the board of Ministers are determined by the Agreement, acts of the Union State, the Provision and these Regulations.

3. The chairman and cabinet ministers cannot act contrary to official position of the Supreme State Council of the Union State (further - the Supreme State Council).

4. Consideration by Council of Ministers of the questions which are within its competence is carried out, as a rule, at meetings of Council of Ministers

5. The Council of Ministers on the basis and in agreement performance issues acts of Council of Ministers in the form of resolutions, directives, resolutions and provides their execution.

The Council of Ministers can accept also recommendations and the conclusions.

6. The procedure for adoption of acts of Council of Ministers is established by the Agreement, acts of the Union State, the Provision and these Regulations.

7. Acts of Council of Ministers can be suspended or repealed by the Supreme State Council.

II. Planning of activities of Council of Ministers

8. Activities of Council of Ministers are performed proceeding from the purposes and tasks of the Agreement, actions of the Program, acts of the Union State, decisions of the Supreme State Council on the basis of perspective programs and current plans. Advance planning is performed by adoption of the action program of Council of Ministers for certain period, complex actions for its realization, target programs and other acts of Council of Ministers. Routine planning is performed by adoption of the draft of the agenda of the regular meeting of Council of Ministers and the plan of preparation of its meeting.

9. Programs (plans) of activities of Council of Ministers are created by Standing Committee on the basis of offers of bodies of the Union State and federal executive bodies of the Russian Federation, republican state bodies of the Republic of Belarus (further executive bodies of the State Parties).

10. Advance planning of activities (action program) of Council of Ministers includes:

a) the list of questions (drafts of the acts of Council of Ministers) which are subject to consideration at meetings of Council of Ministers in the current year;

b) the list of the bills which are subject to consideration at meetings of Council of Ministers taking into account legislative activities of the State Parties.

11. Routine planning of activities (work plan) of Council of Ministers includes:

a) the list of questions (drafts of acts of Council of Ministers) and the bills planned for consideration at the regular meeting of Council of Ministers;

b) the actions plan on preparation of the regular meeting of Council of Ministers.

On each question (the draft of the act of Council of Ministers) and the bill the bodies of the Union State and executive bodies of the State Parties responsible for their preparation are specified, the term of submission of required materials and documents by them in Standing Committee is determined.

12. Not later than 45 days prior to the beginning of the planned period bodies of the Union State and executive bodies of the State Parties represent to Standing Committee of the offer for inclusion in programs (plans) of activities of Council of Ministers containing:

a) the name of question (the draft of the act of Council of Ministers) or the bill with reasons for need of their consideration;

b) general characteristic and basic provisions of the question (the draft of the act of Council of Ministers) offered to consideration or the concept of the bill;

c) form of the decision of Council of Ministers;

d) the executive in charge and collaborators for preparation of question (the draft of the act of Council of Ministers) or the bill to consideration at meeting of Council of Ministers, and also bodies of the Union State and executive bodies of the State Parties with which they shall be approved before entering into Council of Ministers;

e) term of submission by executives in charge of required materials and documents to Standing Committee.

The Council of Ministers considers in accordance with the established procedure offers of Parliament on preparation of bills and coordinates with it the bill activities.

13. On the basis of the arrived offers taking into account opinion of members of the Council of Ministers Standing Committee approves the program (plan) of activities of Council of Ministers.

14. Programs (plans) of work of Council of Ministers go to Parliament and other bodies of the Union State and state bodies of the State Parties.

III. Procedure for preparation, introduction and consideration of drafts of acts of Council of Ministers and other decisions

15. Preparation of the questions (drafts of acts of Council of Ministers) brought for consideration in Council of Ministers is performed by Standing Committee.

16. According to the programs (plans) of activities of Council of Ministers approved by Council of Ministers:

 at the scheduled time, but not later than 45 days before entering of question (the draft of the act of Council of Ministers) into Council of Ministers, the head of the body responsible for preparation of question (the draft of the act of Council of Ministers) represents to Standing Committee:

approved (vised) heads of relevant organs of the State Parties draft of the act of Council of Ministers with necessary appendices to it (in case of introduction of the draft of the act of Council of Ministers);

the explanatory note including reasons for need of consideration of question (adoption of the act of Council of Ministers), necessary calculations, reasons and forecasts of social and economic and other effects of their realization;

executive bodies of the State Parties consider the materials which arrived it on approval concerning the agenda of meetings of Council of Ministers of the Union State no more than one month in time if presidents or the governments of the State Parties do not establish other terms of their approval.
