About approval of "Rules of implementation of customs control"

For the purpose of ensuring execution of subitem 1.1.11 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval of the Customs code of the Azerbaijan Republic" of September 15, 2011 the No. 499 Cabinet of Ministers of the Azerbaijan Republic decides:

Approve "Rules of implementation of customs control" (are applied).

Rules of implementation of customs control

1. General provisions

1.1. These rules are prepared according to Article 92.6.1 of "The customs code of the Azerbaijan Republic" (further - the Customs code) and establish rules of implementation of customs control over goods and vehicles.

1.2. These rules regulate the questions connected with implementation of customs control concerning the goods and vehicles intended for production and commercial purposes in customs and boundary check points and places of customs clearance.

1.3. The goods which are not intended for production or commercial purposes move physical persons through customs border of the Azerbaijan Republic (further - customs border) in the preferential and simplified procedure and customs control concerning these goods is regulated according to the Customs code.

1.4. Customs control is set of the measures performed by customs authorities for the purpose of ensuring compliance with the customs legislation. Customs authorities (further - customs authorities) the Azerbaijan Republic for implementation of customs control use the forms, methods and means established by the legislation.

1.5. Forms of customs control are determined according to Article 92.2 of the Customs code. Officials of customs authorities as exclusive form of customs control perform personal inspection based on the solution of management of customs authority or structural division.

1.6. The measures performed for the purpose of increase in efficiency in case of application of the chosen form of customs control constitute methods of customs control. Officials of customs authorities exercise customs control by the following methods:

1.6.1. with use of means of customs providing;

1.6.2. involvement of specialists and experts for rendering assistance in carrying out customs control;

1.6.3. creation of customs control zones and by other methods, stipulated by the legislation.

1.7. During implementation of customs control customs authorities apply the following means:

1.7.1. means of engineering supervision (detectors, x-ray devices, the copy equipment, mechanical, electric and electronic devices, accompanying constructions in case of customs control, GPS (system of global positioning, etc.);

1.7.2. sea (river) and aircrafts;

1.7.3. information resources of customs authorities;

1.7.4. guard dogs and other means which list is determined by the Cabinet of Ministers of the Azerbaijan Republic, for goal achievement of customs control.

2. List of the documents necessary for customs control

2.1. The following documents are necessary for implementation of customs control:

2.1.1. transport documents;

2.1.2. the declaration containing data on goods and vehicles.

3. Submission of the documents and data necessary for implementation of customs control

3.1. The transport documents necessary for the purposes of customs control are represented by persons to customs authority.

3.2. For the purpose of implementation of customs control and customs clearance by persons the customs declaration according to requirements of customs procedures moves.

3.3. Upon the demand of customs authorities persons submit to customs authority the relevant supporting documents according to the data provided in the customs declaration. According to Article 40.2 of the Customs code person submitting necessary documents bears responsibility for reliability and completeness of the data specified in them.

3.4. The documents which are subject to submission to customs authority according to other legal acts in the field of customs affairs including customs declarations can be provided in electronic form.

4. Use sea (river) and aircrafts of customs authorities for the purpose of implementation of customs control

4.1. When implementing customs control on customs area of the Azerbaijan Republic (further - customs area) customs authorities have the right to use the ocean (river) ships which are available at their order. Ocean (river) ships it is used for the purposes of maintenance and patrol for the purpose of ensuring compliance with the customs legislation within internal waters of the Azerbaijan Republic and the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic.

4.2. During implementation of customs control on customs area customs authorities have the right to use the aircrafts which are available at their order. Aircrafts are used for patrol for the purpose of ensuring compliance with the customs legislation on customs area.

4.3. In the presence of reasonable suspicions of violation of the customs legislation customs authorities for implementation of customs control on the ocean (river) ships which are on customs area of the Azerbaijan Republic having the right to ask for the help other bodies for the purpose of use of the ocean (river) ships which are at their disposal.

5. The customs control which is carried out concerning goods and vehicles at customs check-points

5.1. The customs control exercised by customs authorities concerning the goods and vehicles moved through customs border (imported and which are exported from customs area, including taken by transit), depending on features of movement of goods and vehicles serves simplification, acceleration of customs control, providing, suppression of the omission of goods which import to the Azerbaijan Republic is prohibited.

5.2. The sequence of stages of the customs control exercised by customs authorities concerning the goods and vehicles imported on customs area, and also exported from this territory are determined by these rules.

5.3. For the purpose of simplification of customs clearance of the goods and vehicles moved through customs border check points according to "Rules of use of "Green channel" and other gating systems for transportation of goods and vehicles through customs border", No. 920, based on the short import declaration are applied by the approved Presidential decree of the Azerbaijan Republic of May 21, 2016 systems of green, blue, yellow and red corridors of the admission of goods and vehicles on customs area
