Rules of converting of the pension rights of insured persons in the conditional pension capital

1. General provisions

1. These rules are developed according to the laws of the Republic of Tajikistan "About insurance and national pensions", "About the personified accounting in system of mandatory pension insurance", "About provision of pensions of citizens of the Republic of Tajikistan" and establish procedure for revaluation and accounting of the pension rights of the insured faces acquired till January 1, 1999.

2. Converting of the pension rights in the conditional pension capital and its transfer to individual personal account of insured person is made to all insured persons performing labor activity in the territory of the USSR and the Republic of Tajikistan till January 1, 1999, except for the men who were born in the period till January 1, 1954 and the women who were born till January 1, 1959 in cases of their retirement on age on the established provisions of the law of the Republic of Tajikistan "About provision of pensions of citizens of the Republic of Tajikistan.

3. The regulations of these rules relating to hired employees are equally applied to persons performing individual and business activity.

Converting of the pension rights of insured persons is financed by budget funds of the Agency of social insurance and pensions under the Government of the Republic of Tajikistan.

- working life - duration of labor or public work which is estimated in the procedure established by the legislation;

- territorial authority of social insurance - structural division of the Agency of social insurance and pensions under the Government of the Republic of Tajikistan.

In case of the request for award of pension under the Law of the Republic of Tajikistan "About insurance and national pensions" along with the statement and documents for award of pension in territorial authority of social insurance at the place of residence by insured person move also the statement (appendix No. 1) and the documents necessary for converting of the pension rights (data on labor activity till January 1, 1999).

6. Insured person has the right to refuse converting of its pension rights by filing of application in the approved form (appendix No. 2).

7. The statement is registered territorial authority of social insurance. In case of reception of an application and the documents attached to it completeness and reliability of the data specified in the statement is checked.

8. Registration date of the statement is day of provision in territorial authority of social insurance of all necessary documents.

9. Territorial authority of social insurance in case of documents acceptance in day of the address:

- checks correctness of execution of the statement and compliance of the data stated in it to the submitted documents:

- returns the application in case of its giving without all necessary documents or detection of discrepancies between the data specified in the statement and data. containing in the submitted documents, and also in case of violation of the requirements provided by these rules;

By territorial authority of social insurance within thirty days from the date of obtaining and registration of a statement it is issued insured linden the copy of the decision on transfer of means of the conditional pension capital on individual personal account but the approved form (appendix No. 3).

11. In case of refusal in three-day time after decision about refusal sends to insured person to convertings of its pension rights, territorial authority of social insurance (issues) to the applicant the decision on refusal with indication of cause of failure and procedure for appeal of the made decision (appendix No. 4).

12. Return of the documents submitted for converting of the pension rights is performed by the method allowing to confirm the fact and date of return. In case of return of documents return reasons are specified and necessary explanations are made.
