About the organization and activities of the National agency for safety of foodstuff

For the purpose of accomplishment of provisions of article 1 of the Law No. 113 of May 18, 2012 on establishment of the general principles and instructions of the legislation on safety of foodstuff (The official monitor of the Republic of Moldova, 2012, Art. No. 143-148 467), article 7 of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (The official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 153), with subsequent changes and amendments, and article 4 of the Law No. 228 of September 23, 2010 on protection of plants and phytosanitary quarantine (The official monitor of the Republic of Moldova, 2010, Art. No. 241-246, 748), and also for optimization of structure of bodies with functions of control and supervision in the field of safety of foodstuff the Government DECIDES:

1. Create the National agency on safety of foodstuff, subordinated to the Government, on the basis of reorganization by merge of the Agency of veterinary sanitation and safety of animal products and the Main inspectorate for phytosanitary supervision and seed control.

2. The national agency on safety of foodstuff is successor of the rights and obligations of the bodies which are subject to reorganization and begins the activities since February 14, 2013.

3. To the Ministry of Agriculture and food industry:

a) perform the procedure of reorganization of the Agency of veterinary sanitation and safety of animal products and the Main inspectorate for phytosanitary supervision and seed control according to the current legislation;

b) provide to the Government till December 31, 2013 offers on optimization of structure of territorial subdivisions of the National agency on safety of foodstuff, including material, human and financial resources.

4. To the Ministry of Health (Service of the state supervision of public health) to transfer to the National agency on safety of foodstuff information from the database on units of food profile which are subject to the state supervision in the field of safety of foodstuff.

5. And liabilities, fixed assets and other material values from the bodies which are subject to reorganization to the National agency on safety of foodstuff to perform transfer of assets according to the Regulations on procedure for transfer of the state companies, the organizations, organizations, their divisions, buildings, constructions, fixed assets and other assets approved by the Order of the Government No. 688 of October 9, 1995. (The official monitor of the Republic of Moldova, 1996, No. 10, the Art. 45), with subsequent changes and amendments, within 12 months, and the file - in 30-day time from the date from entry into force of this resolution.

6. Approve:

a) Regulations on the organization and activities of the National agency for safety of foodstuff, according to appendix No. 1;

b) Organizational structure of central office of the National agency on safety of foodstuff and the list of boundary posts of veterinary and sanitary and phytosanitary control, according to appendix No. 2;

c) Regulations on uniform and distinctive marks of employees of boundary posts of veterinary and sanitary and phytosanitary control of the National agency on safety of foodstuff, according to appendix No. 3;

d) Changes and additions which are made to the separate orders of the Government, according to appendix No. 4;

e) the list of the orders of the Government which are recognized invalid

7. Establish the extreme number of the National agency on safety of foodstuff in number of 1422 units, including 171 units of central office and 1251 units of territorial subdivisions, with the annual salary fund according to the current legislation.

8. To the Ministry of Health:

a) till February 14, 2013 to cut down on 200 units staff of Service of the state supervision of public health and assignment for their content, with the subsequent transfer to the National agency on safety of foodstuff;

b) provide to the Ministry of Finance of the offer on introduction of amendments to the Law on the budget for 2013 for providing and accomplishment of provisions of the subitem and) this Item;

c) within a month to bring the regulations into accord with this resolution.

9. Grant to the National agency on safety of foodstuff the right to redistribution of established posts within structure, the number of staff and the established salary fund.

10. Maintenance costs of the National agency on safety of foodstuff will be performed for the account and within the assignments approved annually in the government budget and from other sources according to the legislation.

11. Recognize invalid some orders of the Government according to appendix No. 5.

12. Determine that the National agency on safety of foodstuff is founder of public organization "Republican Veterinary and Diagnostic Center".

13. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry and the Ministry of Health which will submit to the Government the report within 60-day term since the beginning of activities of the National agency for safety of foodstuff.

Regulations on the organization and activities of the National agency for safety of foodstuff

Chapter I General provisions

Scope

1. The regulations on the organization and activities of the National agency for safety of foodstuff (further - the Provision) establish tasks, the main functions, the main obligations and basic rights of the National agency on safety of foodstuff (further - the Agency), and also the organization of its activities.

Legal status of the Agency

2. The agency is the administrative authority subordinated to the Government responsible for implementation of state policy in the field of regulation and control of safety of foodstuff and in the field of veterinary sanitation, zootechnics, protection of plants and phytosanitary quarantine, seed control, quality of raw materials and food foodstuff and forages for animals.

Legislation of activities

3. The agency is effective according to the Constitution, the laws of the Republic of Moldova, presidential decrees of the Republic of Moldova, resolutions of Parliament, ordinances, resolutions and orders of the Government, other legal acts and requirements of this provision.

The agency provides the organization and coordination of actions in the areas directed to guaranteeing safety of foodstuff (except for the foodstuff provided in Item d) article 19 of the Law No. 113 of May 18, 2012 on establishment of the general principles and instructions of the legislation on safety of foodstuff), increase in productivity of animals and plants, and also product qualities of food, maintenance and improvement of welfare of animals and phytosanitary condition of plants, providing systems of the state measures intended for maintenance of health of animals and protection of plants, safety of the food and raw materials received as a result of their conversion.

Main functions of the Agency

6. For the purpose of realization of the mission the Agency is equipped with the main functions:

a) safety of foodstuff and forages for animals;

b) traceability of all food chain;

c) risk analysis;

d) welfare of animals;

e) veterinary health control;

f) seed control;

g) zooengineering supervision;

h) supervision and control of identification, registration and movement of animals;

i) protection, health of plants and phytosanitary quarantine;

j) biological, chemical and physical safety of foodstuff of animal and not animal origin, and also forages for animals;

k) health of animals;

l) control of infectious diseases of animals, zoonozam and zoonotic agents;

m) supervision and control of production, import, sale, use and storage of remedies of the plants and means increasing fertility of soils;

n) supervision and control of the remaining balance of pesticides, means increasing fertility of soils, veterinary medicines and other pollutants;

o) supervision and control of testing, approval, registration, production, storage, transportation, import, export, realization and use of veterinary medical medicines;

p) supervision and control of production of food and hygiene at the companies in the food sector;

q) supervision and control of production of forages for animals and medical fodder, respect for hygiene at the companies for production of forages for animals;

r) supervision and control of use of the genetically modified organisms (GMO);

s) supervision of quality of raw materials, food and forages for animals;

t) authorization and registration of entrepreneurs of the food sector and sector of forages for animals according to the Law No. 160 of July 22, 2011 on regulation of business activity by permission;

u) development, implementation and monitoring of the National plan of official checks;

v) control import, transit and export on border.

Main obligations of the Agency

7. For achievement of the main Agency functions has the following main obligations:

in veterinary and sanitary area:

1) the organization of veterinary and sanitary activities in all territory of the country;

8) authorization of the companies for procurement, conversion, storage, transportation and sales of products and raw materials of animal origin and issue of veterinary and sanitary permission according to the Law No. 160 of July 22, 2011 on regulation of business activity by permission;

9) conducting veterinary and sanitary examination of products and raw materials of animal origin on all objects for procurement, production, conversion, storage, transportation and their realization;

10) issue to the markets, shops, bodies of local public authority, to other legal entities and physical persons of administrative recommendations about use of the products and raw materials of animal origin unsuitable for consumption by the person;

11) control of condition of places of sales of products of animal origin, check of conditions of their storage, control of destruction of products of animal and the phytogenesis unsuitable for consumption by the person and feedings of animals;
