About approval of Rules of the equipment of vehicles (containers) for transportation of goods with customs seals and seals

In connection with the entry of the Kyrgyz Republic into the Customs Union, for the purpose of unification and harmonization of the regulations and documents regulating the organization of customs affairs in the Kyrgyz Republic, the Government of the Kyrgyz Republic decides:

1. Approve the enclosed rules of the equipment of vehicles/containers / for transportation of goods with customs seals and seals.

2. Publish this resolution in mass media.

Rules of the equipment of vehicles (containers) for transportation of goods with customs seals and seals

I. General provisions

1.1. In these rules the following concepts are used:

a) aircrafts (including airplanes, helicopters and other aircraft);

b) road vehicles (including trail cars and semitrailer trucks);

c) railway rolling stock (cars, tanks):

- container - the transport equipment (cage, the removable tank or other similar adaptation):

representing fully or partially the closed reservoir intended for the room of goods in it;

having invariable characteristics and owing to this fact rather strong to serve for many multiple use;

specially designed for simplification of goods by one or several modes of transport without intermediate reloading of goods from one mode of transport on another;

designed so that it could be loaded and unloaded easily;

having unobstructed capacity at least one cubic meter.

Vehicles, accessories and spare parts to vehicles, packagings and pallets do not belong to containers. the concept "Demountable bodies" are considered as containers.

1.2. If at custom union reasons to believe are had that carriers or its vehicle (container) cannot guarantee observance of provisions of the legislation of the Kyrgyz Republic on customs affairs, other legislation of the Kyrgyz Republic and international treaties of the Kyrgyz Republic, control of which execution is imposed on customs authorities of the Kyrgyz Republic, the customs authority has the right to allow goods placement under customs regime of transit or to resolve the goods delivery under customs control to customs authority of appointment only on condition of the proper vehicle (container).

1.3. In the cases determined by international treaties of the Kyrgyz Republic or the State customs inspection under the Government of the Kyrgyz Republic, any vehicles (containers) used for international carriages of goods shall be properly equipped.

1.4. Under ought the equipped means (container) the vehicle is understood, cargo compartments or container of which are designed and equipped so that:

a) goods could not be taken from the sealed cargo compartment (sealed part of container) or to be loaded there without leaving of visible traces of breaking or the damaged customs seals and seals;

b) customs seals and seals could be imposed by easy and reliable way;

c) in them there were no secret places for concealment of goods;

d) all places to which goods can be located were easily available to customs examination.

1.5. For accomplishment of provisions of Item 1.4 of these rules the structure of cargo compartments of vehicles (design of containers) shall conform to the technical requirements established by these rules.

1.6. Vehicles (containers) allowed for transportation of goods with customs seals and seals according to the Instruction about procedure for assumption of vehicles (containers) for transportation of goods with customs seals and seals (further - the Instruction about procedure for assumption), are considered as conforming technical requirements established by these rules, except as specified when in verification process the serious defects giving the chance to take goods from the sealed cargo compartment of the vehicle or container are found or to place them there without leaving of visible traces of breaking or damage of customs seals and seals.

The vehicles (excepting railway rolling stock) allowed to transportation of goods with customs seals and seals according to the Instruction about procedure for assumption shall be followed by the certificate on assumption.

On the containers and railway rolling stock allowed to transportation of goods with customs seals and seals according to the Instruction about procedure for assumption plates about assumption shall be attached.

II. Technical requirements to structure of cargo compartments of vehicles

2.1 The structure of cargo compartments of vehicles shall conform to the following requirements:

a) components of the cargo compartment (walls, door floor, roof, racks, frames cross elements, etc.) shall unite or by means of devices which cannot be removed outside and again delivered into place without leaving of visible traces, or by means of the methods providing such design which cannot be changed without leaving of visible traces. When walls, floor of door and roof are made of different elements, they shall meet the same requirements and to be rather strong;

b) doors and other systems of closing (including locking cranes, covers of manholes, flanges, etc.) shall have adaptation to which customs seals and seals could be set. This adaptation shall be such that it could not be removed outside and again to deliver into place without leaving of visible traces and that doors and the locking devices could not open without damage of customs seals and seals, customs seals and seals shall be appropriately protected. It is allowed to do the opening roofs (hatches);

c) air and drainage vents shall be supplied with the device interfering access in the cargo compartment. This device shall be such design that it could not be removed outside and again to deliver into place without leaving of visible traces.

2.2. In structure of cargo compartments of vehicles availability of components of the cargo compartment which for practical reasons shall include hollow spaces is allowed (for example, between components of double wall). In order that these spaces could not be used for the purpose of concealment of goods:

- it is necessary when the internal covering covers the cargo compartment on all height from floor to ceiling or when the space between covering and external wall is completely closed to provide. that the internal covering fastened so that it could not be removed and returned into place without leaving of visible traces;

- it is necessary when the covering does not cover the cargo compartment on all its height and when the space between covering and and vernal wall is closed not completely, and in all other cases when in structure of the cargo compartment there are naked spaces, to provide that the quantity of the specified spaces was limited to minimum and that these spaces were easily available to customs control.
