Regulations on procedure and conditions of conducting the state sanitary and hygienic examination

1. This Provision establishes procedure and conditions of conducting the state sanitary and hygienic examination (further - examination).

2. Expertize is carried out by the bodies and organizations exercising the state sanitary inspection, for statements of the organizations and individual entrepreneurs (further - applicants) according to the procedure, established by subitem 3.6.2 of Item 3. 6, Items 10.22-10. 26, 10.32 single lists of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330) (further - the single list of ministerial procedures).

3. Objects of examination are:

3.1. products (except for products which are subject to state registration) according to the list established by the resolution of Council of Ministers of the Republic of Belarus of July 11, 2012 No. 635 "About some questions of sanitary and epidemiologic wellbeing of the population" (The national legal Internet portal of the Republic of Belarus, 17.07. 2012, 5/35957);

3.2. projects of sanitary protection zones of nuclear installations and (or) Items of storage, sanitary protection zones of the organizations, constructions and other objects making impact on health of the person and the environment and determined by the Ministry of Health of the Republic of Belarus, zones of sanitary protection of sources and systems of drinking water supply;

3.3. the project documentation on reconstruction, including upgrade, capital repairs in case of which expansion or increase in capacity, and also change of purpose of objects of social, production, transport, engineering infrastructure is performed;

3.4. objects of social, production, transport, engineering infrastructure;

3.5. the works and services constituting potential danger for life and health of the population which list is established by the resolution of the Ministry of Health of the Republic of Belarus of July 17, 2012 No. 104 "About establishment of the list of the works and services constituting potential danger for life and health of the population and recognition No. 75 which voided resolutions of the Ministry of Health of the Republic of Belarus of September 28, 2006" (The national legal Internet portal of the Republic of Belarus, 24.08. 2012, 8/26312);

3.6. working conditions of working;

3.7. projects of technical regulatory legal acts in the field of technical regulation and standardization (except for projects of technical regulatory legal acts, including technical regulations regulating drug circulation, standards of the organizations), technological documentation (except for the technological documentation developed on self-produced products of the organizations of public catering, and the technological documentation including products production processes);

3.8. expiration dates and the storage conditions of food staples and the foodstuff differing from established in technical regulatory legal acts in the field of technical regulation and standardization.

4. The list of the documents necessary for conducting examination, terms of conducting examination, conclusion effective periods (depending on object and the purpose of conducting examination) are established by subitem 3.6.2 of Item 3. 6, Items 10.22-10. 26, 10.32 single lists of ministerial procedures.

5. Examination includes:

acceptance and registration of a statement;

consideration of the submitted documents;

registration and issue to the applicant of the sanitary and hygienic conclusion in form according to appendix to this Provision (further - the conclusion).
