About the Concept of labor migration of citizens of the Republic of Tajikistan abroad

(as amended of the Order of the Government of the Republic of Tajikistan of 07.08.2014 No. 532)

For the purpose of state regulation of questions of labor migration abroad, and also social legal protection of the citizens of the republic who are going abroad for work, the Government of the Republic of Tajikistan decides:

1. Approve the enclosed Concept of labor migration of citizens of the Republic of Tajikistan abroad.

2. Charge to the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan together with the Ministry of Justice of the Republic of Tajikistan, the Ministry of Foreign Affairs of the Republic of Tajikistan. The Ministry of Finance of the Republic of Tajikistan and the Ministry of Economy and Trade of the Republic of Tajikistan till July 1, 2002 to develop the State program of labor migration of citizens of the Republic of Tajikistan abroad and to submit for consideration in the Government of the Republic of Tajikistan.

Concept of labor migration of citizens of the Republic of Tajikistan abroad

1. Prerequisites of labor migration abroad

1. Realization of constitutional rights of citizens on work, social protection of their interests assume employment of economically active population, beyond its limits, way of the organization and regulation of processes of labor migration.

2. Demographic capacity of the Republic of Tajikistan, on the one hand, shortage of financial resources for development of network of the corresponding workplaces, with another, cause excess of manpower. According to technique of the International Labour Organization, by the beginning of 2000 the unemployed in the republic could be considered 16,8 of % of economically active population. According to expert evaluations excessive manpower constitutes more than 30% of their total quantity. At the same time more than 60% of the unoccupied population are constituted by the youth aged up to 30 years having potential opportunities of acquisition of professional skills for work abroad by professions best-selling in the labor markets of the countries of importers of labor power from Tajikistan.

3. Considering low territorial and vocational mobility, and also gender and age structure of free manpower, it is possible to assume that about 30% of the unoccupied population can become potential labor migrants abroad.

4. The labor migration abroad is caused by need, first of all, of mitigation of the social tension caused not by employment of economically active population. In view of lack of legal sources of increase in the income and real economic conditions of increase in living standards of the population by employment within the republic, export of labor power abroad is important factor in the solution of this task.

5. Need of legal and regulated labor migration abroad is caused by interests of receipt of additional currency receipts in the budget of the country at the expense of taxes from is profitable the firmposrednik performing activities for attraction and employment of migrants abroad.

6. The labor migration abroad thanks to implementation by migrant workers of money transfers promotes growth in prosperity of members of their families.

7. The labor migration abroad promotes activization of activities of state bodies and private firms of intermediaries in the sphere of preparation, retraining and advanced training of personnel, workers and specialists.

8. Work and training abroad, promoting growth of qualification of migrant workers, will provide increase in qualification level of cumulative labor power of the republic.

9. In view of the fact that labor earnings of migrant workers are, as a rule, higher, than in the republic, expansion of export of labor power will promote growth of amount of savings of the population which can be important source of investments into national economy.

3. Need of policy of labor migration abroad

10. Labor migration abroad - the phenomenon difficult, ambiguous and therefore requiring close attention and studying, regulation in interrelation with other processes and the phenomena of economic, social and political life of the republic.

11. The state shall influence quite actively processes of labor migration abroad, realization of science-based policy in this area. State policy of the Republic of Tajikistan in the field of labor migration abroad assumes reasons for main objectives, current and its perspective tasks taking into account traditions, customs, national and historical peculiarities of the population of Tajikistan.

4. Main objectives of policy of labor migration abroad

12. Main objective of state policy in the field of labor migration abroad is socially - legal protection of the citizens of the Republic of Tajikistan who are temporarily working abroad, regulation of migration flows, prevention of illegal migration and approval of legality in migratory process.

4.1. Economic targets:

13. Moving of part of manpower of the Republic of Tajikistan to other countries is performed for the purpose of employment of citizens of the republic on more advantageous conditions, than in the territory of the republic.

In the Republic of Tajikistan where for the objective reasons (high natural increase of the population and limitation of financial resources for ensuring so rapid growth of workplaces), the level not of employment promptly increases the naseleniyaeffektivny policy of labor migration abroad is the most important factor of decline in unemployment. As a result of decline in unemployment the considerable effect will be reached in increase in the income of the population.

15. State policy in the field of labor migration abroad shall be directed to complete use of all channels of currency receipts from export of labor power: taxes on profit of intermediary firms; direct money transfers of migrant workers home, on family support and relatives; personal investments of migrant workers (supply home means of production and objects of long-term use, purchase of the real estate, acquisition of securities); the capitals from the countries accepting labor power from Tajikistan going for reproduction of manpower and to the social sphere.

In view of value of currency receipts from migrant workers of the republic abroad and for the purpose of prevention of various violations and speculation in currency means, state policy in the field of labor migration abroad shall provide exchange of foreign currency which owners are the citizens of Tajikistan working abroad at the market rate.

17. Important economic target of state policy of labor migration (regarding export of labor power) in the Republic of Tajikistan consists in that migrant workers as a result of work abroad increased the professional and cultural level, using the programs of professional training of immigrants applied in foreign countries.
