1. Approve the enclosed Rules of transfer, realization, utilization and write-off of property, and also provision in property employment (lease) of real estate of special state bodies of the Republic of Kazakhstan.

2. This resolution becomes effective from the date of signing.

Rules of transfer, realization, utilization and write-off of property, and also provision in property employment (lease) of real estate of special state bodies of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of transfer, realization, utilization and write-off of property, and also provision in property employment (lease) of real estate of special state bodies of the Republic of Kazakhstan (further – Rules) are developed according to item 4 of article 84 of the Law of the Republic of Kazakhstan "About special state bodies of the Republic of Kazakhstan" and determine procedure for transfer, realization, utilization and write-off of property, and also provision in property employment (lease) of real estate of special state bodies of the Republic of Kazakhstan (further – special state bodies).

2. The property of special state bodies is republican and is on the right of operational management of special state bodies.

3. Transfer, realization, utilization and write-off of property of special state bodies, except for the idle property provided in the subitem 33) of article 1 of the Law of the Republic of Kazakhstan "About defense industry and the state defensive order" are performed according to the Law of the Republic of Kazakhstan "About state-owned property", other regulatory legal acts adopted for the purpose of its realization and also these rules.

Transfer, realization and utilization of the idle property of special state bodies provided in the subitem 33) of article 1 of the Law of the Republic of Kazakhstan "About defense industry and the state defensive order" are performed according to the Law of the Republic of Kazakhstan "About defense industry and the state defensive order" and the Rules of transfer, realization, liquidation by means of destruction, utilization, burial and conversion of idle property, and also provision in property employment (lease) of not used defensive objects approved by the order of the Government of the Republic of Kazakhstan of November 6, 2019 No. 832.

Turnover of arms and military equipment is performed according to the Rules of turnover of arms and military equipment approved by the order of the Government of the Republic of Kazakhstan of November 29, 2019 No. 896.

4. Financial accounting of property is made according to the Budget code of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan.

5. The organization of transfer, realization, utilization and write-off of property is performed by the relevant special state bodies in which operational management there is this property.

The instruction for application of Rules affirms the first heads of special state bodies.

6. Discarded property is the property which is written off according to these rules.

Chapter 2. Procedure for cession of property

7. Public institutions of special state bodies have the right to transfer and redistribute property within state body based on the decision of the first head of state body or person authorized by it.

8. The cession of property between state bodies and the organizations is performed by authorized body on state-owned property in coordination with special state bodies in which operational management there is this property.

9. The cession of property is made from balance of organization of the transferring state body to fixed assets of the accepting organization of state body or the organization.

10. Reception-transmission of property is performed in the territory of the asset holder with participation of representatives of the transferring and accepting parties.
