About execution of certificates on the property right to real estate, extraction, information references and statements from the State register of the rights to real estate on special forms and introduction of amendments to some orders of the Ministry of Justice of Ukraine

According to the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings", for the purpose of providing proper implementation of actions on creation of system of state registration of the rights to real estate and their burdenings, streamlining of the relations concerning execution of certificates on the property right to real estate, extraction, information references and statements from the State register of the rights to real estate on special forms of documents of information system of the Ministry of Justice of Ukraine PRIKAZYVAYU:

1. Paragraph two of Item 1 of the order of the Ministry of Justice of Ukraine of April 22, 2003 No. 39/5 chipboard registered in the Ministry of Justice of Ukraine on April 22, 2003 for No. 318/7639 (with changes) to exclude.

2. Paragraph two of Item 2 of the order of the Ministry of Justice of Ukraine of October 06, 2003 No. 121/5 "About approval of new sample of the special form of documents of registers of information system of the Ministry of Justice of Ukraine, to its description and introductions of forms in turnover", registered in the Ministry of Justice of Ukraine on October 6, 2003 for No. 896/8217 (with changes) to exclude.

3. Items 3-5 of the order of the Ministry of Justice of Ukraine of July 14, 2004 No. 67/5 "About approval of the Regulations on procedure for delivery, storage, accounting and the reporting of expenditure of special forms of documents of information system of the Ministry of Justice of Ukraine and modification of some regulatory legal acts of the Ministry of Justice Ukraine", No. 878/9477 registered in the Ministry of Justice of Ukraine on July 14, 2004 (with changes) to exclude.

4. Item 4 of ceased to be valid according to the Order of the Ministry of Justice of Ukraine of 07.04.2014 No. 598/5

Make changes in the Sample and the Description of the special form of the certificate on the property right approved by the order of the Ministry of Justice of Ukraine of April 22, 2003 No. 39/5 chipboard registered in the Ministry of Justice of Ukraine on April 22, 2003 for No. 319/7640 (with changes), having been reworded as follows them which are applied (for office use).

6. Determine that execution of certificates on the property right to real estate is performed by the state registrar of the rights to real estate, the notary, the official of local government body, the administrator of the center of provision of administrative services on special forms of certificates on the property right which Sample and the description are approved by the order of the Ministry of Justice of Ukraine of April 22, 2003 No. 39/5 chipboard registered in the Ministry of Justice of Ukraine on April 22, 2003 for No. 319/7640 (with changes).

7. Approve the Sample and the Technical description on the special form for issue of statements from the State register of the rights to real estate which are applied (for office use).

8. The special form for issue of statements from the State register of the rights to real estate which Sample and the Technical description is approved by this order is used in all cases when it is provided registration and issue of statements from the State register of the rights to real estate, including for issue of excerpts in the cases specified in Item 9 of this order after complete use of special forms for issue of excerpts from the Proprietorship register on real estate which Example and the description are approved by the order of the Ministry of Justice of Ukraine of April 22, 2003 No. 39/5 chipboard registered in the Ministry of Justice of Ukraine on April 22, 2003 for No. 318/7639 (with changes).

9. 10. Determine that execution of statements from the State register of the rights to real estate is performed by the state registrar of the rights to real estate with use of special forms of documents of registers of information system of the Ministry of Justice of Ukraine which description and sample No. 121/5, No. 896/8217 registered in the Ministry of Justice of Ukraine on October 06, 2003 is approved by the order of the Ministry of Justice of Ukraine of October 06, 2003 (with changes).

11. Determine that the expenses connected with the organization production and delivery of special forms of certificates on the property right, special forms for issue of statements from the State register of the rights to real estate, special forms of documents of registers of information system of the Ministry of Justice of Ukraine are performed at the expense of the state company "Information center" of the Ministry of Justice of Ukraine.

12. Procedure for delivery, storage, accounting and reporting on expenditure of special forms of certificates on the property right, special forms for issue of statements from the State register of the rights to real estate, special forms of documents of registers of information system of the Ministry of Justice of Ukraine it is determined by the Regulations on procedure for delivery, storage, accounting and the reporting of expenditure of special forms of documents of information system of the Ministry of Justice of Ukraine approved by the order of the Ministry of Justice of Ukraine of July 14, 2004 No. 67/5, No. 878/9477 registered in the Ministry of Justice of Ukraine on July 14, 2004 (with changes).

13. To the state company "Information center" of the Ministry of Justice of Ukraine (Dobzhansky V. B.):

provide deliveries of special forms of certificates on the property right, special forms for issue of statements from the State register of the rights to real estate, special forms of documents of registers of information system of the Ministry of Justice of Ukraine to bodies of state registration of the rights and notaries, persons who according to the Law of Ukraine "About state registration of the rights to real estate and their encumbrances" can carry out powers of the state registrar on receiving and delivery of documents, according to their powers;

stop the order of special forms for issue of excerpts from the Proprietorship register on real estate which Example and the description are approved by the order of the Ministry of Justice of Ukraine of April 22, 2003 No. 39/5 chipboard registered in the Ministry of Justice of Ukraine on April 22, 2003 for No. 318/7639 (with changes).
