About approval of the Regulations on procedure for participation of Boundary police in international missions and transactions

(as amended of the Order of the Government of the Republic of Moldova of 21.11.2018 No. 1145)

For the purpose of providing the mechanism of participation of Boundary police in international missions and transactions the Government DECIDES:

1. Approve Regulations on procedure for participation of Boundary police in international missions and transactions it (is applied).

2. To impose control over the implementation of this resolution on the Ministry of Internal Affairs.

Regulations on procedure for participation of Boundary police in international missions and transactions

Chapter I General provisions

1. The regulations on procedure for participation of Boundary police in international missions and transactions (further - the Provision) determine procedure for the organization, condition of participation of Boundary police in the international missions and transactions performed abroad and also work payment terms.

2. The concepts used in this Provision mean the following:

international missions - participation of specialized structure at the request of the international bodies in training events, creation of the international forces for accomplishment of tasks within measures for conflict prevention and settlement of crisis situations, conciliation, assistance, training and control;

the international transactions - the actions permitted by the authorized international bodies, performed with the consent of the parties, and designed to provide observance of the signed agreements and to promote safety of frontier.

3. The fields of participation of Boundary police in international missions and transactions are:

1) participation in actions for control of border;

2) fight against illegal migration and other cross-border crimes connected with illicit movement of persons and vehicles;

3) participation in transactions on detention of persons who committed offenses and crimes.

4. The boundary police can participate in international missions and transactions according to international treaties and agreements which party the Republic of Moldova is.

5. Participation of foreign state or the international organization in international missions and transactions in the Republic of Moldova is performed based on international treaties which party is the Republic of Moldova, with observance of the national legal system.

6. Participation of boundary police officers in international missions and transactions is performed on competitive basis.

Chapter II Method of the organization of tender

7. The procedure of the organization and carrying out tender is based on the following principles:

transparency - extensive informing on conditions of participation in international missions and transactions, providing open entry for participation in tender, bringing to data of all concerned parties of information on procedure for the organization and carrying out tender;

objectivity - creation of equal conditions for all candidates, ensuring selection on the basis of accurately certain criteria and single technique for assessment of level of competence of candidates;

professionalism - selection on the basis of the received results of the most competent persons.

8. Information on tender is placed on the web page of the General inspectorate of Boundary police at least in 20 days prior to its beginning.

9. The announcement without fail contains:

1) the name and the address of the body organizing tender;

2) name of position;

3) conditions of participation in tender;

4) the list of documents which shall be provided;

5) deadline of submission of documents;

6) phone number, electronic and post addresses for more information, person responsible for documents acceptance.

10. Any boundary police officer who in addition to the criteria established by foreign state or the international organization under the auspices of which the international mission or transaction is carried out corresponds to at the same time following criteria can take part in tender:

1) at least 5 years have the education necessary for performance of the mission or transaction, and working life in Boundary police;

2) it is estimated within the last office assessment by assessment "very well";

3) knows foreign language of the international communication at the average level;

4) at the time of tender has no outstanding sanctions in the country or abroad for disciplinary violations or making of offenses in case of accomplishment of international missions and transactions;

5) it is suitable for performance of the mission or transaction from the medical point of view.

11. Tender includes the following stages:

1) examination on special preparation - written examination;

2) holding interview - oral examination.

12. The contest committee establishes date, time and the venue of written examination with placement of the relevant information on the web page of the General inspectorate of Boundary police and on message board in the place of its stay at least in 3 days prior to date of its carrying out. Along with it candidates are informed personally on date, time and the venue of written examination by means of electronic mail / phone / notice in writing under list.

13. The interview will be organized not later than 3 working days from the date of holding written examination. The candidate list, allowed on interview, date and time of holding interview are placed on the web page of the General inspectorate of Boundary police and on message board in the place of its stay. At the same time candidates are informed personally on date, time and the venue of interview by means of electronic mail / phone / the written notice under list.

14. Results of tender are entered in the protocol which within 2 working days from the date of carrying out tender is submitted to the chief of the General inspectorate of Boundary police.

15. Only candidates for participation in the international transactions and missions participate in tender, and boundary police officers who leave in the international organizations or foreign countries in official journeys, do not participate in tender.

16. The members of the contest committee affirm the order of the chief of the General inspectorate of Boundary police.

17. The contest committee representatives of the petitioning foreign state or the international organization can be included.

18. The commission performs the following functions:
