About approval of the Procedure for provision of social services with establishment of the differentiated payment and modification of the list of social services, conditions and procedure for their provision of the territorial center of social servicing by structural divisions (provision of social services)

According to part six of article 7 of the Law of Ukraine "About social services" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for provision of social services with establishment of the differentiated payment which is applied.

2. Bring in the list of social services, conditions and procedure for their provision of the territorial center of social servicing by structural divisions (provision of social services) approved by the resolution of the Cabinet of Ministers of Ukraine of December 29, 2009 No. 1417 "Some questions of activities of the territorial centers of social servicing (provision of social services)" (The Official Bulletin of Ukraine, 2010, No. 1, the Art. 10, No. 43, Art. 1407; 2011, No. 94, Art. 3427; 2012, No. 7, the Art. 249, No. 85, the Art. 3460), changes which are applied.

Procedure for provision of social services with establishment of the differentiated payment

1. This Procedure determines procedure for granting of social services with establishment of the differentiated payment.

2. Social services with establishment of the differentiated payment in the amount determined by state standards of social services are provided by the companies, organizations, the organizations and organizations, irrespective of pattern of ownership, physical persons entrepreneurs who answer criteria of activities of the subjects providing social services with attraction of budgetary funds (further - subjects).

3. Social services with establishment of the differentiated payment are provided to persons having the right to their obtaining according to the Law of Ukraine "About social services" except persons having the right to receive such services free of charge.

4. The differentiated payment for provision of social services is established proceeding from average monthly comprehensive income of person for the previous calendar year in the sizes which are not exceeding:

75 percent of the specified income - in case of provision of social services of stationary leaving, palliative/hospice care in the conditions of hospital;

12 percent - in case of provision of social services of home care, palliative care at home, day care, the supported accommodation, provision of shelter;

5 percent - in case of provision of social services of representation of interests, mediation (mediation), the natural help;

3 percent - in case of provision of social services of social adaptation, social integration and reintegration, social resettlement, consultation, social maintenance during employment and on workplace, social prevention.

 If person who needs provision of social services with establishment of the differentiated payment (further - person) receives several social services, the amount of such payment is determined proceeding from bigger percent, but cannot exceed 75 percent of average monthly comprehensive income of person.

The amount of the monthly differentiated payment for provision of social services cannot exceed costs of the services provided within a month.

5. For calculation of the amount of the differentiated payment for provision of social services of the data on the income persons move GFS, the Pension fund of Ukraine, Social Insurance Fund to structural divisions concerning social protection of the population of the local state administration, executive body of city, district council in the city or executive body of council of the integrated territorial community which is formed according to the law and the perspective plan of forming of the territories of communities (further - authorized body), according to Item 8 of this Procedure.

For calculation of the income of unemployed persons which are granted pension for the first time or which left work during the period for which the income is considered and have no other income, except pension, at the request of person the size of the gained income for previous year or the size of the granted monthly pension in calculation in 12 months is considered.

The cost of social services is calculated based on the rates for paid social services estimated according to the Procedure for regulation of rates for paid social services approved by the resolution of the Cabinet of Ministers of Ukraine of April 9, 2005 No. 268 (The Official Bulletin of Ukraine, 2005, No. 15, the Art. 759).

6. The difference between the amount of the differentiated payment and cost of social service is compensated according to the legislation.

7. For receipt of social services person or his legal representative gives to authorized body in the place of residence/stay:

the statement for needs in provision of social services with establishment of the differentiated payment in the form established by Minsotspolitiki;

certificates of the income - in case of availability of other gained income, information on which is absent in GFS, the Pension fund of Ukraine, Social Insurance Fund and according to the legislation it cannot be received at the request of authorized body according to the present of the Procedure.

Person or his legal representative who addresses for provision of social services are responsible for the provided information on the income which affected or could influence establishment of the amount of the differentiated payment.

8. For establishment of the amount of the differentiated payment data are submitted within five-day term from the date of receipt of request of authorized body:

about the income of persons from the State register of physical persons taxpayers - GFS according to the procedure established by Minsotspolitiki and the Ministry of Finance;

about the income of persons from the register of insured persons of the State register of obligatory national social insurance - the Pension fund of Ukraine according to the procedure, established by the Pension fund of Ukraine and Minsotspolitiki.

9. The authorized body within five working days from the date of filing of application draws up the statement of inspection of material living conditions of accommodation of person in the form established by Minsotspolitiki.
