According to item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the Presidential decree of Ukraine of May 12, 2011 No. 581, article 5 of the Charter of the railroads of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of April 06, 1998 No. 457 of PRIKAZYVAYU:

1. Approve the Procedure for application of the electronic document management connected with carriage of goods by railway transport which is applied.

2. To provide to public administration of rail transport of Ukraine:

2.1. Submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

2.2. Timely bringing this order to permission of consignors, consignees and population of Ukraine.

3. This order becomes effective from the date of its official publication.

4. I reserve control over the implementation of this order.

Procedure for application of the electronic document management connected with carriage of goods by railway transport

I. General provisions

1.1. This Procedure regulates application on rail transport of electronic documents: sheets of payment for use of cars of the GU-46, form of the instruction sheet of giving / zabiranii cars of the GU-45, form of the instruction sheet of issue/acceptance of containers of the GU-45K form, the sheet of payment for giving, zabiraniye of cars and shunting operation of the GU-46A form, the sheet of payment for use of containers of the GU-46K form, the message on the end of cargo operations with cars according to appendices 1, 2, 8, 10, 11, 12 to the Instructions for use cars and containers approved by the order of the Ministry of transport of Ukraine of February 25, 1999 No. 113, registered in the Ministry of Justice of Ukraine on March 15, 1999 for No. 165/3458, and also accumulative card of charges for works (services) and the penalties connected with carriage of goods (cargo baggage), the FDU-92 form according to appendix 3 to Rules of calculations for carriage of goods the approved order of the Ministry of transport of Ukraine of November 21, 2000 No. 644, registered in the Ministry of Justice of Ukraine on November 24, 2000 for No. 864/5085, and the message on time of giving of cars for loading or unloading, from the moment of their creation before destruction.

1.2. This Procedure is obligatory for application by all subjects of electronic document management who interact in the engineering procedures connected with carriage of goods by railway transport.

1.3. The relations connected with electronic document management are regulated by the Constitution of Ukraine, the Civil code of Ukraine, the Economic code of Ukraine, the Laws of Ukraine "About information", "About information security in information and telecommunication systems", "About telecommunications", "About the digital signature", "About electronic documents and electronic document management", the resolution of the Cabinet of Ministers of Ukraine of October 28, 2004 No. 1452 "About approval of the Procedure for application of the digital signature by public authorities, local government bodies, companies, organizations and organizations of the state pattern of ownership", the Charter of the railroads of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of April 06, 1998 No. 457, the order of the Ministry of transport of Ukraine of November 21, 2000 No. 644 "About approval of separate Sections of Rules of carriage of goods" registered in the Ministry of Justice of Ukraine on November 24, 2000 for No. 861/5082 (further - Rules of carriage of goods), the order of the State committee of archives of Ukraine of April 25, 2005 No. 49 "About approval of the Procedure for storage of electronic documents in archive organizations", the Collection of cargo rates registered in the Ministry of Justice of Ukraine on June 07, 2005 for No. 627/10907, by rail within Ukraine and the related services approved by the order of the Ministry of Transport and Communications of Ukraine of March 26, 2009 No. 317, registered in the Ministry of Justice of Ukraine on April 15, 2009 for No. 340/16356, other existing regulatory legal acts.

1.4. In this Procedure terms are used in such value:

the railroad - authorized territorial branch association which part the companies, organizations and the organizations of rail transport are and which performs public conveyance and loads in certain region of transportation network;

the worker of the railroad - the worker performing functions on creation, processing, transfer of carriage documents which are given in Item 1.1 of this Section.

1.5. Carrier (the railroads, the companies, organizations, the organizations of rail transport), consignors and consignees can be subjects of electronic document management.

The procedure of electronic document management during carriage of goods by railway transport in regional traffic is regulated by the agreement on the organization of carriages of goods and carrying out calculations for transportation and the services provided by the railroad which form is given in appendix 1 to the Rules of calculations for carriage of goods approved by the order of the Ministry of transport of Ukraine of November 21, 2000 No. 644, registered in the Ministry of Justice of Ukraine on November 24, 2000 for No. 864/5085 (further - the agreement on the organization of transportations).
