The agreement between the Government of the Russian Federation and the Government of the Kyrgyz Republic on interaction when implementing export of military products to the third countries

The government of the Russian Federation and the Government of the Kyrgyz Republic which are hereinafter referred to as with the Parties

being guided by the Treaty of friendship, cooperation and mutual aid between the Russian Federation and the Republic Kyrgyzstan of June 10, 1992, the Agreement between the Government of the Russian Federation and the Government of the Kyrgyz Republic on military and technical cooperation of August 25, 1999,

aiming to provide favorable conditions for development of military and technical cooperation,

recognizing need of ensuring protection of political, military and technical and economic interests of the states of the Parties by delivery of products, works and military services to the third countries,

agreed as follows:

Article 1

The concepts used in this agreement mean the following:

"military products" - arms, military equipment, ammunition, spare parts, components, auxiliary, rear and other military and technical property, technical documentation (normative and technical, design, technological, operational and program), regulating military turnover of products, lease, financial leasing of arms and military equipment, scientific and technical assistance in the organization of development, production, upgrade, repair, operation and destruction (utilization) of military products;

"authorized bodies of the Parties" - the state bodies determined according to the legislation of the states of the Parties under which authority questions of state regulation of military and technical cooperation are;

"the subject of military and technical cooperation" - the organization, the company, consolidation which according to the legislation of the states of the Parties are granted the right to implementation of foreign trade activity concerning military products;

"the third countries" - the states, not being participants of this agreement;

"export of military products" - the export (sale, transfer) of military products made by subjects of military and technical state cooperation of the Parties;

"intellectual property" - is understood in the value specified in article 2 of the Convention establishing World Intellectual Property Organization, signed in Stockholm on July 14, 1967 with changes of September 28, 1979.

Article 2

The parties perform interaction in the field of export to the third countries of the military products which were purchased or received by the state of one Party at the state of other Party, military products of coproduction (development) or upgrade, and also as agreed by the parties - the same military products which are available for the states of the Parties.

The order of interaction when implementing export to the third countries of the specified products is determined by authorized bodies of the Parties.

Action of this agreement does not extend to military products which mutual deliveries are performed according to the Agreement between the Government of the Russian Federation and the Government of the Kyrgyz Republic on production and scientific and technical cooperation of the companies of defensive industries of January 18, 1994.

Article 3

Authorized bodies of the Parties on the organization of accomplishment of this agreement are:

from the Russian Federation - Committee of the Russian Federation on military technically cooperation with foreign states;

from the Kyrgyz Republic - the Ministry of Foreign Trade and the industries of the Kyrgyz Republic.

Article 4

The military products are exported in the export make determined by authorized bodies of the Parties and the organizations - head developers of the state (states) of that Party (Parties) where these products were developed.

Article 5

Delivery of military products to the third countries is performed by the subject of military and technical cooperation of the state of one of the Parties determined by authorized bodies of the Parties.

Article 6

Authorized bodies of the Parties through subjects of military and technical state cooperation of the Parties carry out the approved information marketing activity in the markets of arms of the third countries on the basis of separate arrangements.

Article 7

In case of interaction in implementation of export of military products subjects of military and technical state cooperation of the Parties sign the necessary contractual documents determining conditions of export and procedure of payments for it with the permission of authorized bodies of the Parties.
